ORDINANCE NO. 856 (#8-87)
AN ORDINANCE AMENDING ORDINANCE NO. 782 FOR THE PURPOSE OF
CLARIFYING FIRE DEPARTMENT PERSONNEL OVERTIME COMPENSATION;
DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, under the current Employees Personnel Handbook,
the Jacksonville Fire Department firemen are to be compensated in
a manner not in compliance with the Federal Labor Standard Act;
and,
WHEREAS, the City of Jacksonville, Arkansas, has been in
compliance with all Federal Labor Standard Act regulations
regarding fire personnel overtime compensation despite the incon-
sistency of the Employees Personnel Handbook;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1: Ordinance No. 782 shall be amended to include
the following provisions:
OVERTIME AND COMPENSATORY TIME. Section 2. Fire Department per-
sonnel are to be compensated for overtime [any hours worked over
fifty-three (53) hours per week] at the rate of one and one-half
times (11a) their normal compensation rate in accordance with FLSA
standards. Volunteer firefighters will be compensated at the rate
of Five and 00/100 Dollars ($5.00) per hour for any hours worked.
If a volunteer firefighter works in excess of FLSA approved hours,
said volunteer will be compensated in accordance with FLSA stan-
dards.
SECTION 2: It is hereby ascertained and declared that an
emergency exists and this Ordinance, being necessary for the imme-
diate preservation of the public peace, health, and safety, shall
take effect and be in force from and after its passage.
SECTION 3: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
