0912 cyo ORDINANCE NO. 9 1 2 (#13-89) AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF JACKSONVILLE, ARKANSAS, FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY THE QUESTIONS OF ISSUING BONDS FOR VARIOUS CAPITAL IMPROVEMENTS; PRESCRIBING OTHER MATTERS RELATING THERETO; AND DECLARING AN EMERGENCY WHEREAS, the City Council of the City of Jacksonville, Arkansas (the "City"), has determined that various needed capital improvements, as specifically described in Section 2, can be financed only by the issuance of bonds in the aggregate principal amount of $710,000; and WHEREAS, issuance of bonds for each purpose is subject to the approval of the electors of the City; and WHEREAS, the City Council has determined that in order to retire the bonds it will be necessary to levy an ad va,lorem tax on taxable property within the City at a rate of not to exceed 0.8 mills on the dollar of the assessed value of the property; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Jacksonville, Arkansas: SECTION 1. A special election shall be held on Novem- ber 7, 1989. There sha,ll be submitted to the electors of the City at the special election the questions of issuing bonds for each of the purposes in the respective amounts specified in Section 2. The m,ax,imum rate of the tax to retire the bonds shall be stated on the ballot. SECTION 2. The ballot shall be in substantially the following form: Vote on each question by placing an "X" in the square opposite the question either for or against: Question One: FOR the issuance of bonds in the m,aximum, principal amount of $350,000 for the purpose of acquiring, constructing and equipping an air park and museum, relating to the Little Rock Air Force Base and to aviation, on lands of the United States Air Force at the Little Rock Air Force Base, at a total estimated cost of $650,000 (the balance of the funds to be provided by grants or donated funds). / / AGAINST the issuance of bonds in the maximum principal amount of $350,000 for the purpose of acquiring, constructing and equipping an air park and museum, relating to the Little Rock Air Force Base and to aviation, on lands of the United States Air Force at the Little Rock Air Force Base, at a total estimated cost of $650,000 (the balance of the funds to be provided by grants or donated funds). / / ,?I Question Two: FOR the issuance of bonds in the maximum principal amount of $60,000 for the purpose of renovation and repair of the City's library. / / AGAINST the issuance of bonds in the maximum principal amount of $60,000 for the purpose of renovation .and repair of the City's library. / / Question Three: FOR the issuance of bonds in the maXlmum principal amount of $300,000 for the purpose of acquiring, constructing a,nd equipping recreational facilities, including three outdoor ball parks. / / AGAINST the issuance of bonds in the maximum principal amount of $300,000 for the purpose of acquiring, constructing an,d equipping recreational facilities, including three outdoor ba,ll park,s. / / The bonds that are approved will be combined into a single issue of bonds, which may be issued at one time or in series from time to time. If bonds for all proposed purposes are approved, there will be levied a con- tinuing annual ad valorem tax on taxable property located with the City of Jackson- ville at a rate of not to exceed 0.8 mills on the dollar of the assessed value of the property. In the event that bonds for fewer than all the proposed purposes are approved, the rate of the ad valorem tax will be sufficient to retire the bonds that are approved and are issued. SECTION 3. The City Clerk is authorized and directed to give notice of the election by one publication in a news- paper having general circulation within the City. The publication shall be made not less than ten (10) days prior to the election. SECTION 4. The election shall be held and conducted and the vote canvassed and the results declared under the law and in the manner now provided for municipal elections. SECTION 5. The Mayor shall proclaim the results of the election by issuing a proclamation and publishing the same one time in a newspaper having general circulation in the City. The results as proclaimed shall be conclusive unless suit challenging the results is filed in the Circuit Court of Pulaski County within thirty (30) days after the publication of the proclamation. SECTION 6. A copy of this Ordinance shall be given to the Pulaski County Board of Election Commissioners so that the necessary election officials and supplies may be provided. f~ SECTION 7. Subject to the approval of the electors, the issuance of bonds for the purposes and in the amounts specified in Section 2 is hereby authorized. The bonds shall be issued under the authority of Amendment 62 to the Constitution of the State of Arkansas and the Local Government Bond Act of 1985. SECTION 8. All ordinances and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. SECTION 9. It is hereby ascertained and declared that there is an immediate need for the capital improvements described in this Ordinance in order to promote and protect the health, safety, and welfare of the City and its inhabitants and that the improvements can be accomplished only by the issuance of the bonds. It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of public peace, health and safety shall be in force and take effect immediately from and after its passage.
