ORDINANCE NO. 906 (#7-89)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
PURCHASING A BOX CULVERT FOR THE CITY OF JACKSONVILLE, ARKANSAS;
DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, it is necessary for the City to purchase a precast
concrete box culvert for the purpose of drainage and street repairs
within the city limits of the City of Jacksonville; and,
WHEREAS, Dalworth Quickset of Benton, Arkansas, is the
only supplier of this type of precast concrete box culvert in the
State of Arkansas; and,
WHEREAS, Dalworth Quickset of Benton, Arkansas, can supply
competitive prices with out-of-state suppliers without the risk of
large freight charges if purchased from these suppliers;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purpose of
purchasing a precast concrete box culvert would be costly and
non-productive, making said competitive bidding unfeasible and
impractical.

SECTION TWO: Competitive bidding is hereby waived,
pursuant- to Arkansas Code of 1987 Annotated ~14-58-~ for the
purpose of purchasing a precast concrete box culvert, and author-
ization is given to the City Engineer to enter into a contract
with Dalworth Quickset of Benton, Arkansas, to provide said
culvert.
SECTION THREE: This Ordinance shall take effect and be in
force from and after its passage.
SECT~ON !:Q.UR: It being necessary to protect the public
health, safety, and welfare by providing proper drainage and
street repairs within the city limits of the City of Jacksonville,
it is hereby declared that an emergency exists and this Ordinance
shall be in force and take effect immediately upon its passage.
