ORDINANCE NO. 900 (1 - 89)
AN ORDINANCE WAIVING COMPE~I~IVE BIDDING FOR ~HE PURCHASE OF A
MO~OR GRADER FOR ~HE JACKSONVILLE S~REE~ DEPAR1MEN~; DECLARING AN
EMERGENCY; AND FOR 01HER PURPOSES.
WHEREAS, in serving the needs of the citizens, the
Jacksonville street Department is in need of a motor grader in
order to provide more effective and efficient service; and,
WHEREAS, the motor grader is extremely beneficial to the
members of the Street Department in providing the services
necessary to maintain and construct the streets in the City of
Jacksonville; and,
WHEREAS, the current grader is a 1957 model, which has long
outlived its service life and is no longer practical to maintain
because of the costs and time required to make repairs; and,
WHEREAS, there is only one local company, Little Rock Road
Machinery Company, that supplies used motor grader equipment and
will accept the trade-in of our 1957 model grader. Little Rock
Road Machinery Company has obtained a used Galion Motor Grader
for the City at an amount much less than a new grader.
NOW, ~HEREFORE, BE 11 ORDAINED BY 1HE CIiY COUNCIL OF iHE
CI1Y OF JACKSONVILLE, ARKANSAS, iHA1:
SEC1ION 1: It is hereby ascertained and declared that,
because of the necessity of such equipment in providing efficient
and effective service to the citizens of Jacksonville, an
emergency is declared for the purpose of purchasing a used motor
grader for the Jacksonville Street Department. It is, therefore,
declared that an emergency exists and this Ordinance, being
necessary for the immediate preservation of the public peace,
health, and safety, shall take effect and be in force from and
after its passage.
SEC1ION 2: Competitive bidding for the purpose of
purchaslng--a Galion Motor Grader for the Jacksonville street
Department would be costly, non-productive, and time consuming,
making such competitive bidding unfeasible and impractical.
SECTION 3: Competitive bidding is hereby waived, pursuant
to Arkansas Code of 1987 Annotated S14-58-303 for the purpose of
purchasing a used Galion Motor Grader for the Jacksonville street
Department, and authorization is hereby given to the City
purchasing Department to obtain such equipment from the Little
Rock Road Machinery Company.
SEC~ION 4: Any Ordinance in conflict herewith is specifi-
cally reiJeated to the extent of such conflict.
