1511ORDINANCE NO, 1511 (#04 -14) AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR PAYMENT OF EMERGENCYREPAIRS TOA MAIN STREET TRAFFICSIGNAL EQUIPMENT; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES, WHEREAS, after a contractor's accident, it has been necessary to make emergency repairs to damaged traffic signal equipment at Main and Marshall. While the City will seek reimbursement from the responsible party(ies), the City Council must authorize payment of the repair costs to avoid additional charges; and, WHEREAS, said services were promptly provided by LEG Enterprises, Inc. of Cabot at a reasonable rate and completed quickly as needed. LEG Enterprises, Inc. is a sole source of such repairs, having completed work on the City's signaling system equipment before. As such, City Staff recommends waiver of competitive bidding and request approval to pay LEG Enterprises, Inc. for said repair services. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OFIACKSONVILLE, ARKANSAS, THAT: SECTION ONE; Competitive bidding for payment of emergency repairs to the Main and Marshall traffic signaling system equipment after a contractor's accident for the City of Jacksonville would be costly and non-productive, making said competitive bidding unfeasible and impractical. SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA §14-58-383, to authorize payment of the traffic signaling repairs and service provided by LEG Enterprises, Inc. to the City of Jacksonville. Authorization is hereby given to the Mayor and City Clerk to submit full payment to LEG Enterprises, Inc. of Cabot, Arkansas, all for a cost not to exceed Twenty-seven Thousand Two Hundred Seventy-two and 35/100 Dollars ($27,272.35). As well, City staff is authorized to seek reimbursement of said amount paid from the responsible party(ies) of the accident that caused the damage and need for repairs. ORDINANCE NO. 1511 (#04 — 2014) PAGE TWO SECTION THREE; All Ordinances, parts of Ordinances, or previous actions taken by said Council in conflict herewith are hereby repealed to the extent of such conflict. SECTION FOUR; This Ordinance, necessary for the maintenance of public facilities and the health, safety, and welfare of the citizens of Jacksonville, should be implemented immediately.
