ORDINANCE NO. 1045 (#9-95)
AN ORDINANCE AMENDING VARIOUS JACKSONVILLE MUNICIPAL CODE
SECTIONS (18.08, 18.20.020, 18.24.030, 18.26.030, 18.28.030,
18.32.030, 18.36.030, 18.38.030, 18.44.030, 18.48.030,
18.52.030, 18.56.020, 18.60.030) SETTING FORTH REQUIREMENTS
FOR CONDITIONAL USES IN VARIOUS ZONING CLASSIFICATIONS WITHIN
THE CITY OF JACKSONVILLE, ARKANSAS; DECLARING AN EMERGENCY;
AND, FOR OTHER PURPOSES.

WHEREAS, the Jacksonville Municipal Code provisions
regarding permitted zoning classifications and conditional
uses is in need of amendment to provide for the inclusion of
various uses and acti vi ties, incl uding mul ti -purpose uses,
throughout the various zoning classifications;
WHEREAS, the Jacksonville Planning Commission is and has
been working diligently to update and modify those provisions
of the Code involving zoning and property regulations, and
have discovered that day care faci I i ties are not I isted as
conditional uses in any zoning classification, thus
prohibiting the operation of a day care by an industry and in
certain locations in Jacksonville; and,
WHEREAS, under State Law and City Code, the Jacksonville
Board of Adjustment/Planning Commission must then approve all
conditional uses in all zoning classifications, and will
serve as the reviewing body for any appl ication submi t ted
under said provisions.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Section 18.08 (Definitions) is hereby
amended to include the following:
18.08.241 - Day Care Facility - Any building, lot, or portion
thereof used for the care, custody, education, nurturing, and
training of children and adults on a daily basis.
SECTION TWO: Various sections of the Jacksonville
Municipal Code (18.20. 020, 18.24.030, 18.26.030, 18.28. 030,
18.32.030, 18.36.030, 18.38.030, 18.44.030, 18.48.030,
18.52.030, 18.56.020, 18.60.030) are hereby amended to allow
the operation of a day care facility as a conditional use in
the following zoning classifications: A-I; R-Q through R-5;
C-l; C-3; C-4; M-l; and, M-2.
SECTION THREE: All Ordinances or
conflict with this Ordinance are hereby

SECTION FOUR: It is hereby ascertained and declared
that efficient statements and provisions in the zoning laws
of the City of Jacksonville are needed, and passage of this
Ordinance can insure such provisi ons . I t is, therefore,
declared that an emergency exists and this Ordinance, being
necessary for the immediate preservation of the public peace,
health, and safety, shall take effect and be in force from
and after its passage.
