ORDINANCE NO. 1033 (116-94)
AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO APPROVE
AND EXECUTE ALL DOCUMENTS NECESSARY FOR THE TRANSFER OF 488
SQUARE FEET OF MUNICIPAL PROPERTY LOCATED AT THE INTERSECTION
OF CENTER STREET AND NORTH FIRST (.HIGHWAY 161), JACKSONVILLE,
ARKANSAS; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES.

WHEREAS, the City of Jacksonville, at the request of the
Arkansas Highway Department, has determined it appropriate
and beneficial to the City to transfer certain real property
belonging to the City (as more particularly described herein)
to aid in the widening of Highway 161 through Jacksonville;
and
WHEREAS, the Arkansas state Highway Commission has
agreed to accept said property and maintain the area in order
to facilitate a four (4) lane highway expansion, and the
City Engineer recommends that the City Council authorize said
transfer of property.
NOWI THEREFORE I BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City Council hereby approves and
authorizes the transfer of the real property described below
to the Arkansas state Highway Commission.
SECTION TWO: The Mayor and City Clerk are hereby
authorized to execute and approve any and all documents
necessary to complete the transfer of the following described
real property.
Part of Lots 11 and 12, Block 24 of the Original Town of
Jacksonville, Pulaski County, Arkansas, more
particularly described as follows:
Starting at the Northwest Corner of Lot I, Block 24, of
the Original Town of Jacksonville, also being a point on
the Southerly existing right of way line of East Center
street; thence North 470 02' 18" West along said
existing right of way line a distance of 25.20 feet to a
point on the Easterly proposed right of way line of
State Highway 161 for the point of beginning; thence
North 880 12' 18" West along the Easterly proposed right
of way line of State Highway 161 a distance of 19.00
feet to a point; thence South 090 02' 54" West along
said proposed right of way line a distance of 55.44 feet
to a point on the Easterly existing right of way line of
state Highway 161; thence North 010 47' 42" East along
said existing right of way line a distance of 77.73 feet
to a point on the Southerly existing right of way line
of East Center Street; thence South 470 02' 18" along
said existing right of way line a distance of 34.54 feet
to the point of beginning and containing 488 square
feet, more or less.
GENERAL LOCATION: Intersection of Center street and
North First (Highway 161), Jacksonville, Arkansas,
containing approximately 488 square feet of land.

SECTION FOUR: Immediate transfer of this property is
required in order that the Arkansas state Highway Department
may begin the proposed project. Therefore I an emergency is
hereby declared, and this Ordinance shall take effect
immediately upon its passage and publication, as provided by
and subject to applicable law.
