ORDINANCE NO. 1029 (112-94)
AN ORDINANCE AUTHORIZING ASSESSMENT AND COLLECTION OF A
PROBATION FEE BY THE JACKSONVILLE MUNICIPAL COURT; AND, FOR
OTHER PURPOSES.

WHEREAS, operation of the Jacksonville Municipal Court
Probation Di vision has proven to be cost I y to the Court,
making it necessary to assess and collect a monthly fee from
those defendants placed on probation to offset the costs
incurred in providing such services; and,
WHEREAS, through research, study, and review, it is
determined that a monthly fee of up to and including Twenty
Dollars ($20.00) per defendant on probation would assist in
offsetting the operation of this Division of the Court.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City of Jacksonville Municipal Court
shall hereinafter have authority to assess a court cost of up
to and including Twenty Dollars ($20.00) per month per
defendant placed upon probation and/or served through the
Probation Division of the Jacksonvi 11 e Municipal Court for
violation of Arkansas statutes.
SECTION TWO: The Clerk of the Court and/or its
designated and authorized representative shall, as described
by ACA 16-17-119, collect those probation costs paid by
defendants of the Jacksonville Municipal Court and provide a
report and accounting of said fees on a monthly basis to the
City. Said costs shall be colI ected and paid into General
Funds of the Ci ty , to be used for general operation and
support of the Jacksonville Municipal Court and other
government operations as the City Council deems appropriate.
SECTION THREE: All Ordinances, or parts thereof, in
conflict with this Ordinance are hereby repealed to the
extent of said conflict.
SECTION FOUR: This Ordinance shall take effect from and
after its passage and publication, as provided by applicable
law.
