ORDINANCE NO. 1112 (#22 - 98)
AN ORDINANCE VACATING AND CLOSING NIXON AIVJJ THOMAS
STREETS, JACKSONVILLE, ARKANSAS (GEIVJ;!;RAL LOCA TION: THE
PORTIONS OF NIXON AND THOMAS STREETS LYING EAST OF BAILEY
BOULEVARD); AIVJJ, FOR OTHER PURPOSES.

WHEREAS, the Planning Commission of the City of Jacksonville has
reviewed the proposed closure and abandonment of Nixon and Thomas
Streets lying east of Bailey Boulevard and has no opposition to such subject
to replacelllent of various municipal utility easelllents needed for said
property; and,
WHEREAS, the City Council hosted a public hearing December 17,
1998, with notice duly published as required by law. At said hearing,
adjoining property owners and utility companies expressed consent to th.e
closing of saId street, subject to reservatIon of easelllent rights for said
utilities.
NOW, THEREFORE, BE IT ORDAI1vJ;!;D AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE:
follows is:
The streets located in the Little Rock Air Force Base Main Gate
Development Area (Recorded in Plat Book 5, Page 8, Pulaski
County Court House, Little Rock, Arkansas), more particularly
described as follows:
The real property, more particularly described as
Thomas Street from the East right-of-way line of Bailey
Boulevard to the West right-of-way line of U. S. Highway 67-
167.
And
Nixon Street from the East right-of-way line of Bailey Boulevard
to the West right-of-way line ofU. S. Highway 67-167.
(GENERAL LOCATION: Nixon and Thomas Streets lying east of Bailey
Boulevard, Jacksonville, Arkansas.)
Said property is hereby closed and vacated under the powers granted to
cities of the first class in the State of Arkansas, subject to reservation of
easement rights and privileges for private and municipal utility companies.
The Mayor and City Clerk are hereby duly authorized and directed to enter
into an agreement with those adjoining and abutting property owners of
Nixon ana Thomas Streets lying east of Bailey Boulevard to close and
abandon said street, with th.e real property described reverting to said
property owners in accordance with state law.
SECTION TWO: A copy of this Ordinance, duly certified by the City
Clerk, shall be filed in the OffIce of the Recorder of the County and recorded
in the Deed Records of the County, here by amending the plat recorded on
November 1, 1920, in the Pulaski County Circuit Clerk Records.
SECTION THREE: All Ordinances, ")arts of Ordinances, or
previous actions taken by said Council in con~1ict herewith are hereby
repealed to the extent of such conflict.

SECTION FOUR: This Ordinance shall take effect and be in force
from and after its passage.
