070300016 RESOLUTION NO, 703 (#12 -- 2013) A RESOLUTION AUTHORIZING THE MAYOR AND/OR HIS DESIGNEE TO SUBMIT AN APPLICATION TO THE ARKANSAS DEPARTMENT OF PARKS AND TOURISM OUTDOOR RECREATION GRANT TO OBTAIN 50/50 MATCHING GRANT FUNDS FOR CREATION OF AN OUTDOOR ARCHERY RANGE RECREATIONAL FACILITY FOR THE CITY OFJACKSONVILLE; AND, FOR OTHER PURPOSES, WHEREAS, the City of Jacksonville, Arkansas, recognizes the need to enhance and improve the recreation facilities in Jacksonville, specifically the City's Shooting Range under construction, by including development and construction of an outdoor Archery Range at the facility. The plans for said recreational improvement have been prepared, and the price is established. However, because funds are short, it is possible for the City's Parks & Recreation Department to submit an application for a 50/50 Matching Grant from the Arkansas Department of Parks and Tourism Outdoor Recreation Grant Program for funds to help develop and construct said improvement; and, WHEREAS, the Mayor and the City Council understand that, if granted funds for development of an Archery Range, the Mayor and Council agree to provide the necessary land upon which the Archery Facility(ies) will be developed, that said lands will meet all relevant specifications and requirements for an Archery Range and shall be maintained as an outdoor recreation use in perpetuity, and that the City will be obligated to enter into a binding agreement with the Arkansas Department of Parks & Tourism binding the City to the policies and procedures contained in the Land and Water Conservation Fund Grants Manual. Said provisions may include, but will not be limited to, requirements that all present and future utility lines within the project boundary be routed away from the project or placed underground, that the facility(ies) will be available for use by the public at all reasonable times at reasonable rates except for limited periods of reserved events, league play, and maintenance needs, that the City will maintain and operate such in a clean, safe, and healthful manner, and that the City will provide the matching monies needed for the development and continued operation of such a facility(ies). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITYOFJACKSONVILLE, ARKANSAS, TRA T.- SECTION ONE: The Mayor and/or his designee is/are hereby authorized to make application to the Arkansas Department of Parks and Tourism on behalf of the City of Jacksonville for a 50/50 Matching Grant for assistance in the development and construction of an outdoor Archery Range recreational facility as part of the City's Shooting Range currently under construction on Graham Road. SECTION TWO; Any and all other Resolutions in conflict herewith are hereby repealed to the extent of said conflict. This Resolution shall be in effect from and after its date of passage.
