AN ORDINANCE ACCEPTING AND CONFIRMING ANNEXA TION OF VARIOUS REAL
PROPERTY LOCA TED ON THE SOUTHEAST SIDE OF JACKSONVILLE (COMMONL Y
REFERRED TO AS THE SOUTHEAST ANNEXA TION); DECLARING AN EMERGENCY;
AND, FOR OTHER PURPOSES.

WHEREAS, through Resolution No. 559 (#4-02), the Jacksonville City Council urged the
submission and approval 0" a Petition for Annexation of various real property located in the Southeast
portion of Jacksonville, commonly referred to as the Southeast Annexation;
WHEREAS, said Petition for Annexation was filed, Public Notice was duly published, and a
Public Hearing was held on June 26,2002. Subsequently, County Judge Floyd G. Villines III entered
an Order of Annexation for the following described property into the City of Jacksonville. Under
statute, the City Council must now confirm and accept said Annexation action by Judge Villines.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: The following described property is hereby annexed and accepted
into the City of Jacksonville, Arkansas:
Property on the Southeast side of the City of Jacksonville, more particularly
described as follows:
TRACT A
Part of the West 1/2 of Section 28, Township 3 North, Range 10 West, Pulaski
County, Arkansas, being more particularly described as follows:
Commencing at the NE corner of the SW 1/4 of Section 28, Township 3 North, Range
10 West; Thence S 020 20' 55" W, along the East line of said Section, 117.11 feet to
the point of beginning; thence S 020 20' 55" W, 1214.73 feet to the SE corner of the
N E 1/4 of the SW 1/4 of said Section; thence S 10 15' 15" W along the East line of
the SW 1/4, 990.88 feet; thence West 604.93 feet to a point 262.97 feet North of the
North right-of-way line of Arkansas State Highway 294 and located on the East right-
of-way line of a 50 feet access easement; thence Northwest to a point on the West
right-of-way line of the access easement and 388 feet North of the North right-of-way

way line of Loop Road and the point of beginning; thence South along East right-of-

SECTION TWO: The City hereby declares its intention to extend City utility services
to said areas within a reasonable time frame. Portions of the area involved currently have water and
sewer main lines through the area, and the area has been and is being served by the Police, Fire, and
Emergency Services Departments. Sanitation services and other City services are to be extended
within a reasonable time frame as service expansion allows. "
SECTION THREE: All Ordinances or parts of Ordinances and Resolutions in conflict
herewith are hereby repealed to the extent of said conflict.
SECTION FOUR: It is hereby ascertained and declared that this Ordinance is
necessary for immediate implementation 0': greater efficiency in governmental and emergency
services operations. Therefore, an emergency is hereby declared, and this Ordinance shall take effect
immediately upon passage and publication, as provided by and subject to applicable law.
