AN ORDINANCE REMOVING CERTAIN PROPERTY FROM THE CONDEMNA TION LIST.
MODIFYING JACKSONVILLE MUNICIPAL ORDINANCE NO. 1180; AND, FOR OTHER
PURPOSES.

WHEREAS, the City Council of Jacksonville, Arkansas, by and through passage of Ordinance
No. 1180 (#10 - 02', in accordance with ACA 914-56-201, e1. al. and JMC ~8.28 e1. seq., condemned
certain real properties and declared such properties a public nuisance, hazardous, and structurally
unsound. Included in said declaration was the real property located at 212 East Pine Street,
Jacksonville, Arkansas, owned by James M. and Shelbe J. Greene; and,

diligently since the City Council passed said c.eclaratlon. Mr. and Ms. Greene have removed
all conditions and made such re Jairs as necessary to bring said Jro Jerty into compliance .with
all applicable City Code Jrovisions and returnea the property anc its improvements to a
structurally sound and sa':e Jroperty. As such, said Jroperty should be removed from the
condemnation list and t1e nuisance declaration voidec at tlis time.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS:
SECTION ONE: The Jacksonville City Council hereby finds that the structure located
on the property at 212 East Pine Street, Jacksonville, Arkansas, owned by James M. and Shelbe J.
Greene, is now in compliance with applicable State law and City Code provisions and no longer
constitutes a nuisance, safety hazard, or has existence of non-complYing conditions upon said
property. Given the owners' diligent efforts since said declaration of condemnation, it is hereby
declared that said Jroperty shall be and hereby is removed from the current condemnation list and is
no longer declarec to be or constitute a public nuisance.
SECTION TWO: In doing so, the City Council specifically amends and modifies
Ordinance No. 1180, passed on June 6, 2002, and removes the Jroperty rocated at 212 East Pine
Street, Jacksonville, Arkansas, from the current condemnation lis':.
SECTION THREE: Should any part(s) of this Ordinance be declared invalid for any
reason, no other part(s) of the Ordinance shall be affected thereby.
SECTION FOUR: All Ordinances or parts of Ordinances and Resolutions in conflict
herewith are hereby repealed to the extent of said conflict.
