AN ORDINANCE ACCEPTING AND CONFIRMING ANNEXATION OF
VARIOUS REAL PROPERI f LOCATED ON THE LOCATED ON THE
SOUTHEAST SIDE OF JACKSONVILLE (COMMONLY REFERRED TO AS THE
SOUTHEAS I ANNEXATION); DECLARING AN EMERGENCY; AND, FOR
OTHER PURPOSES.

WHEREAS, through Resolution No. 1240 (#2-05), the Jacksonville City
Council urged the submission and a) Jroval of a Petition for Annexation of various
real property located in Southeast Jacksonville, commonly referred to as the
Southeast Annexation;
WHEREAS, said Petition for Annexation was filed, Public Notice was duly
pubis:led, and a PU) ic Hearing was held on February 22, 2005. Subsequently,
County Judge Floyd G. Villines III entered an Order of Annexation for the following
described property into the City of Jacksonville. Under statute, the City Council
must now confirm and accept said Annexation action by Judge Vi lines.
NOW, THEREFORE, BE I. ORDAINED AND ENACTED BY THE CII f

SEL lION TWO: The City hereby declares its intention to extend City
utility services to said areas within a reasonable time frame. Portions of the area
involved currently have water and sewer main lines through the area, and the area
has been and is being served by the Police, Fire, and Emergency Services
Departments. Sanitation services and other City services are to be extended within
a reasona) e time frame as service expansion allows.
SEL lION I HREE: All Ordinances or Jarts of Ordinances anc Resolutions
in conflict herewith are hereby repealed to the extent of said conflict.
SEe lION FOUR: It is hereby ascertained and declared that this Ordinance
is necessary for immediate implementation of greater efficiency in governmental
and emergency services operations. Tlerefore, an emergency is hereby declared,
and this Ordinance shall take effect immediate y upon passage and PU) ication, as
provided by and subject to applicable law.

ORDER CONFIRMING ANNEXATION
On this day this matter is presented for confirmation of Annexation. Petitioners,
Pulaski County Special School District (Murrell Taylor Elementary School), Jacob M. Rich
and Leanna Rich, Lucille Fletcher, Johnny W. Bradley, Sr.,The Crutchfield Family Revocable
Trust, Robert Fischer and Mary Jane Fischer, and the City of Jacksonville, Arkansas, appear
through counsel. From the evidence presented, the Court finds as follows:
1) This Court has jurisdiction of this matter.
2) Annexation of the real property described in Paragraph Three (3) below and
commonly known as the Southeast Annexation is hereby confirmed as being annexed into
the City of Jacksonville, Arkansas.
3) The following described real property is hereby annexed into the City of
Jacksonville, Arkansas:
TRACT A - Pulaski County Special School District (Murrell Taylor Elementary School)
Part of the SE 1/4 of the SW 1/4 of Section 28, Township 3 North, Range 10
West; beginning at the NW corner of the SE 1/4 of the SW 1/4 of said

4) The City Council of the City of Jacksonville, Arkansas, hereby adopted and has
approved Ordinance No. 1244 (#5 — 05) accepting and confirming said Southeast
Annexation, thereby completing the necessary requirements to effect this annexation. A
certified copy of said Ordinance is attached hereto and included herein.
5) The property described above hereby is and shall now be included within the
perimeter of the City of Jacksonville corporate limits.
