AN ORDINANCE MODIFYING JACKSONVILLE MUNICIPAL
CODE 613.16 REGARDING WATER USER RATES ASSESSED;
CREATING JACKSONVILLE MUNICIPAL CODE 6613.16.011 -
13.16.015; AND, FOR OTHER PURPOSES.
WHEREAS, water user rate fees for customers of the Jacksonville Water
Commission have not been increased since tle year 2000, and current cost of
operation and improvements mandated for the Utility require additional
operational revenue; and,
WHEREAS, the Jacksonvi Ie Water Commission 0 Jtained an engineering
study regarding user rates, and tle results of said study mandate a substantial
increase in rates assessed for customers of the Jacksonville Water Commission.
Because of the financial impact of the new rates on customers, the Jacksonville
City Counci Je ieves it appropriate to adopt, authorize, and impose a Rate
Increase Plan to Je p lased in over the next four (4) ca endar years to assist in
the continued operation and improvement of the Jacksonville Water system.
NOW, THEREFORE, BE J I ORDAINED BY THE CIII' COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THA T:
SEe lION ONE: Jacksonville Munici Jal Code 913.16.010 (Water Rates
- Inside City Limits) is amended, modified, and corrected, in part, to include t le
following Four Year Rate Increase Plan:
A) Revenues collected as a result of User Rates levied shall be
deposited in non-lapsing funds known as the Revenue and Operating Fund and
t le Emergency Equipment Rep acement Fund. Fisca year-end balances in these
funds s la Je used for no ot ler purposes t lan t le operation and maintenance of
t le Jac <sonvi Ie Water Commission.
B) All customers of the Jacksonville Water Commission shall be billed
on a monthly basis. Monthly user fees assessed for each customer shall be
determined each month on the Jasis of t le fo lowing rate and calendar year
schedu e:

SECTION SEVEN: Because financial constraints prevent and restrict the
efficient and effective operation of the Jacksonville Water Commission, the need
for immediate implementation of this Ordinance is imperative. As such, this
Ordinance shall be in effect from and after January 1, 2005, subject to and by
applicable publication, as provided by and subject to the requirements of
app ica) e law.
