AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF JACKSONVILLE,&.
ARKANSAS, FOR THE PURPOSE OF OBTAINING ADDITIONAL AMOUNTS Or-
ASPHAL TING AND MILLING SERVICES FOR THE CITY OF JACKSONVILLE DURING THE
REMAINING 2004 CONSTRUCTION SEASON; DECLARING AN EMERGENCY; AND, FOR
OTHER PURPOSES.

WHEREAS, as Jhalting and milling services were bid earlier in the year Jroviding a
com Jetitive Jrice for said services to t le Citizens of t le City of Jac <sonvi Ie; anc,

provides our 2004 asplalting and miuing services las done so at a fair and reasonable rate.
As such, it is recommenc edllat t le City contract wit 1 =res lour for adc itiona asphalting and
milling services during the remainder of the 2004 construction season, and Freshour has
agreeCl to Jrovide sucl1 needed services with a J Jro Jriate guarantees and warranties at the
same fair anc reasona J e rate ( Jic ) a Jproved ear ier t lis year.
BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of obtaining additional
as Jhalting and milling services would be costly, non- Jroductive, and time consuming, making

SECT 0 ~ TWO: Jursuant to ACA ~ 14-58-383, competitive Jidding is lere JY
waived for t le purpose of 0 Jtaining additiona asp la ting and mi ing services for t le remainder
of t le 2004 construction season. Aut lorization is lere JY given to t le v1ayor and/or lis
designated representative to execute necessary documents with Freshour Construction Co.
Inc., of Cabot, Arkansas, for a contractual agreement to provide additional asphalting ant
milling services in accordance with ap Jrovecf s Jecifications from the earlier bid awara anc
c irectlon of the City Engineer's Office for the remainder of the 2004 construction season. Said
