0380 RESOLUTION NO. 3 8 0 (i3 - 87)
A RESOLUTION AUTHORIZING A LEASE AGREEMENT BETWEEN THE CITY OF
JACKSONVILLE, ARKANSAS, AND THE BAYOU TWO WATER USERS DISTRICT;
DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, in order for the Bayou Two Water Users District to
provide adequate water pressure to their users, it is necessary to
install an above ground booster pump station so that the elevated
storage tanks may be utilized; and,
WHEREAS, according to relevant information, the best loca-
tion for the above ground booster pump station is a fifty (50)
foot square area of the Graham Road Landfill. This portion of the
Graham Road Landfill is not within the fenced portion of the land-
fill and will not create any health hazards for the Bayou Two Water
Users District.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1: The Mayor and the City Clerk are hereby
authorized to enter into a Lease Agreement with the Bayou Two
Water Users District for the following described real property:
Part of the Northwest Quarter (NWI/4) of Section 27, Town-
ship 3 North, Range 10 West, Lonoke County, Arkansas,
being more particularly described as follows:
Commencing at the point of intersection of the South
right -of -way line of Graham Road and the Pulaski County -
Lonoke County Line; thence East along said South right -
of -way line, 50.0 feet to the point of beginning; thence
continuing East along said South right -of -way, 50.0 feet;
thence South 50.0 feet; thence West 50.0 feet; thence
North 50.0 feet to the point of beginning: Containing
0.06 acres, more or less.
SECTION 2: The term of the Lease shall be for ninety -nine
(99) years in exchange for consideration of Ten Dollars ($10.00),
with the City Attorney's Office directed to draft an appropriate
Lease Agreement for the above described property.
SECTION 3: Any and all Resolutions or parts of Resolutions
in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 4: It is hereby ascertained and declared that an
emergency exists and this Resolution, being necessary for the
immediate preservation of the public peace, health, and safety,
shall take effect and be in force from and after its passage.
