RESOLUTION NO. 652 (#14 —2010)

A RESOLUTION AUTHORIZING AND APPROVING A WATER PURCHASE
CONTRACT BETWEEN THE CITY OF JACKSONVILLE, ARKANSAS, AND THE
LONOKE /WHITE PUBLIC WATER AUTHORITY OF THE STATE OF ARKANSAS;
AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas is a participating utility in the Lonoke /White
Public Water Authority of the State of Arkansas ( LWPWA') Project, which will bring surface
water from Greers' Ferry Lake to the North Central Arkansas area; and,
WHEREAS, it is in the interest of the City of Jacksonville to enter into the attached Water
Purchase Contract (the "Agreement ") with LWPWA, whereby the City will obtain an individual
interest in the water treated and transported via the LWPWA Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
1 SECTION ONE: The Agreement, in substantially the form presented at the
Council Meeting at which this Resolution is addressed, is hereby approved, and the Mayor and
1 111 City Clerk of the City are hereby authorized to execute the Agreement on behalf of the City, with
such changes as may be approved by the Mayor consistent with the Agreement presented and
the terms of this Resolution.
SECTION TWO: The Mayor and City Clerk of the City of Jacksonville,
Arkansas, are hereby authorized to execute such writings and take such actions as may be
appropriate to carry out the terms of this Resolution consistent with the purposes of this
Resolution, including execution of the Agreement. Such action is hereby ratified.
SECTION THREE; It has been found that the Agreement is plainly in the
interest of the City and that its execution is essential to the development of a future supply of
water to be made available pursuant to the Agreement. Therefore, this Resolution, being
necessary for the preservation of the public health and safety, shall be effective upon and after
its d.te of adoption.
