ORDINANCE NO. 1221 (#5 - 04)
AN ORDINANCE MODIFYING ZONING PROVISIONS IN JACKSONVILLE
MUNICIPAL CODE 118.24.040 AND 118.68 (CHART #1) TO MODIFY
BUILDING SETBACK REQUIREMENTS IN GATED COMMUNITIES WITHIN
THE CII " OF JACKSONVILLE; AND, FOR OTHER PURPOSES"

WHEREAS, requests have been made by local builders and developers to
reduce the residential building setback line from Thirty-five feet (35') to Twenty-five
feet (25'), particularly in the development of gated communities witlin our City;
and,
WHEREAS, to modify said requirements will be consistent with residential
front setback lines used in surrounding communities.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CII "
COUNCIL OF THE CI I t' OF JACKSONVILLE, ARKANSAS..
SECTION ONE: Jacksonville Municipal Code ~ 18.24.040 is hereby
modified as fo lows: In development of R-O property contained within a gated
community, minimum front building setback will be Twenty-five feet (25').
SECTION TWO: Jacksonville Municipal Code ~ 18.68, (Chart #1) is
hereby modified to reflect a minimum Twenty-five Feet (25') front building setback
line for R-O properties lying within or as a part of a gated community within the City
of Jacksonville's planning jurisdiction.
SECTION THREE: A ordinances or parts of ordinances and reso utions in
conf ict lerewit 1 are lere)y repea ed to t le extent of said conflict.
SECTION FOUR: This Ordinance shall take effect immediately upon
passage and publication, as provided by and subject to the requirements of
applicable law.
