0341 c 2 - (e° 6 -85 RESOLUTION NO. 3 4 1 (6-85) RESOLUTION ACKNOWLEDGING THE NECESSITY OF ACQUIRING PROPERTY ADJACENT TO THE NORTHWEST CORNER OF JOHNSON PARK AUTHORIZING THE CITY ENGINEER TO CERTIFY APPRAISALS AND ESTABLISH JUST COMPENSATION FOR SAID PROPERTY. WHEREAS, the Community Development Agency proposes acquisi- tion of the following described property in the City of Jacksonville: Part of the West 1/2 of the Northeast V4 of the Southeast 1/4, Section 29, T -3 -N, R -10 -W, in the City of Jacksonville, Pulaski County, Arkansas, being more particularly described as follows: Beginning at a point that is 543.71 feet North and 196.0 feet East of the Southeast Corner of the W1/2 NE1/4 SW14, Section 29, T -3 -N, R -10 -W; thence West, 145.0 feet; thence N 1 55' E, 129.45 feet; thence East, 145.0 feet; thence S 1° 55' W, 129.45 feet to the point of beginning, containing 0.43 acres, more or less. WHEREAS, the acquisition of certain property in the Henry Estates Addition was undertaken by the Jacksonville Community Development Agency for the purpose of clearance of land of said property; and WHEREAS, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (P.L. 19 -646) establishes uniform policies and requirements for the acquisition of real property under all Federally- assisted programs which are subject to said Act; and WHEREAS, a recipient of Community Development Block Grant funds is required to certify appraisals and establish just com- pensation for property acquired in connection with any project that is assisted with said funds; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: Section 1. The need for the acquisition of certain pro- perty described above is hereby acknowledged as said property is unsuitable and in a hazardous condition and constitutes a public hazard and nuisance and it would be in the best interests of the City to acquire said property. Section 2. The City Engineer is hereby authorized to cer- tify appraisals and establish just compensation for the aforemen- tioned property in accordance with the requirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970. Section 3. Upon acquisition of the property by the City, the property shall be cleared of any buildings, fixtures and additions. Witness our hands this 7th day of Mwtah , 1985.
