ORDINANCE NO. 1217 (#1 - 04)
AN ORDINANCE MODIFYING JMC ~ 2.46.010; ESTABLISHING A FILING
DEADLINE FOR INDEPENDENT OR NONPARTISAN CANDIDA TES IN
ELECTIONS FOR CITY OF JACKSONVILLE MUNICIPAL OFFICES; DECLARING
AN EMERGENCY; AND, FOR OTHER PURPOSES.

WHEREAS, Act 1104 of 2003 allows cities to establish a filing deadline for
independent or nonpartisan candidates seeking election for City of Jacksonville
Municipal Offices for no earlier than twenty (20) days prior to the preferential
primary election and no later than noon on the day before the preferential primary
election.
WHEREAS, City officials and residents will benefit from full knowledge prior
to any election of all possible candidates for municipal elected positions.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THA T:
SECTION ONE: The City Council of the City of Jacksonville hereby
authorizes the establishment of a filing deadline for independent or nonpartisan
candidates seeking election for City of Jacksonville Municipal Offices for no earlier
than twenty (20) days prior to the preferential primary election and no later than
noon on the day before the preferential primary election.
Jacksonville Municipal Code 9 2.46.010 is hereby modified to include the
provisions contained herein.
SECTION TWO: The City Clerk is hereby directed to publish this
Ordinance once a week for two (2) consecutive weeks immediately following
adoption of said Ordinance in a newspaper having a general circulation in the City
of Jacksonville.
SECTION THREE: The provisions of this Ordinance are severable. If any
provision hereof shall be held to be invalid, such holding of invalidity shall not affect
the validity of applicability of the remainder of the provisions thereof.
SECTION FOUR: All Ordinances or parts thereof in conflict herewith are
hereby repealed to the extent of said conflict.
SECTION FIVE: An emergency is hereby declared to exist and this
Ordinance being necessary for the immediate preservation of the public peace,
welfare, health, and safety, and this Ordinance shall be in full force and effect from
and after its passage and approval.
