ORDINANCE NO, 1407 ( #12 -10)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
PURCHASE, REFURBISHMENT, AND INSTALLATION OF SKATE PARK
EQUIPMENT FOR JACKSONVILLE PARKS & RECREATION; DECLARING AN
EMERGENCY; AND, FOR OTHER PURPOSES.
WHEREAS, Jacksonville Parks & Recreation Department received a grant
award to refurbish, upgrade, and install additional Skate Park equipment and
facilities within the City of Jacksonville; and,
WHEREAS, a particular company, American Ramp Company, installed the
City's original equ and has the unique ability to refurbish its own equipment
and install compatible upgrades and has additional such equipment and structures
that will enhance the Skate Park facility available to properly modify the revisions
and re- development of our Community s Skate Park. As well, American Ramp has
agreed to provide such refurbishment, upgrade and installation at a cost equivalent
to the federal bidding contract rates which will insure a competitive amount being
paid by the City of Jacksonville. As a result, solicitation of and publication for
competitive bidding would be of no assistance and would actually delay installation
of needed upgrades and improvements for the City's Skate Park facilities.
NOW THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT ::
SECTION ONE: Competitive bidding to refurbish, upgrade, and install
additional Skate Park equipment and facilities at various locations within the City of
Jacksonville Parks & Recreation Department would be costly and non - productive,
making said competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to ACA
§14 -58 -383, to refurbish, upgrade, and install additional Skate Park equipment and
refurbishment of existing facilities for the Jacksonville Parks & Recreation
Department. American Ramp Company of Joplin, Missouri, is hereby authorized to
order, install, and manufacture the necessary refurbishments and improvements for
the various Skate Park as directed and specified by the Jacksonville Parks &
Recreation Department all for a cost not to exceed Twenty-eight Thousand One
Hundred Thirty-one and 26/100 Dollars ($28,131.26), together with any applicable
tax.
SECTION THREE: All Ordinances, parts of Ordinances, or previous actions
taken by said Council in conflict herewith are hereby repealed to the extent of such
conflict.

SECTION FOUR: This Ordinance, necessary for the improvement of public
facilities and the health, safety, and welfare of the citizens of Jacksonville, should be
implemented immediately. Therefore, an emergency is hereby declared, and this
Ordinance shall be in force and effect from and after its date of passage.
