1406 ORDINANCE NO. 1406 ( #11 -10) AN ORDINANCE SUBMITTING TO THE VOTERS OF THE CITY OF JACKSONVILLE, ARKANSAS, AND OTHER AFFECTED PERSONS, THE U a N OF ANNEXATION TO THE CITY OF JACKSONVILLE, ARKANSAS, TAI CONTIGUOUS TERRITORIES; DECLARING AN EMERGENCY; AND, C ti Pli OT R PURPOSES. PUS 20 4 HE' EAS, it appears to the City Council of the City of Jacksonville, Arkansas, 5A\t t .. ` -rein described territories contiguous to said City are necessary for the ?0 I p N s =L ` :� • continued growth of the City; WHEREAS, the lands described herein and as reflected on the attached maps are platted and held for sale or use as municipal lots or, whether platted or not, are held to be sold and developed as suburban property; WHEREAS, the lands described herein furnish the abode for a densely settled community and represent the actual growth of the City of Jacksonville beyond its legal boundaries; WHEREAS the lands described herein and reflected on the attached maps are also needed for proper municipal purposes by the City of Jacksonville; and, WHEREAS, the lands described herein are valuable by reason of their adaptability for use for and to the City of Jacksonville. THEREFORE BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: There shall be submitted to the qualified electors of the City of Jacksonville, Arkansas, and the real properties and areas described herein and as reflected on the attached maps the question of the annexation of the herein described real properties and territories into the City of Jacksonville, Arkansas. The territories contiguous to the City of Jacksonville, Arkansas to be annexed therein are more fully described as follows: Highway 67 NE Area Annexation A part of Sections 28, 29, 32 & 33, T4N, R1OW and Sections 4, 5 & 6 T3N, R1OW, Pulaski County, Arkansas being more particularly described as follows: Beginning at the SE corner of Section 33, T4N, R1OW; Thence North along the East line of said Section 33 to the South line of Section 28, T4N, R1OW; Thence North along the East line of said Section 28 N 1° W 515 feet of the Northerly right of way of Highway 67; Thence S 68° 40' 27" W, 85'3.72 feet to the North right of way of Republican Road; Thence Westerly along the North right of way of Republican Road to the East line of section 29, T4N, R1OW; Thence continuing on the North right of way line to the West line of the SE 1/4, of the SE 1/4 of said Section 29• Thence South crossing Republican Road and along the West line of the East 1 /2 of the East 1/2 of Section 32 T4N, R1OW to the North line of Section 5, T3N R1OW; Thence West 111 along the North line of said Section 5 to the NE corner of Section 6, T3N R1OW; Thence South along the East line of said Section 6 to the North line o the South 1/2 of the North 1 /2 of said Section 6; Thence West along the North line of the South 1/2 000030 1 ORDINANCE NO. 1406 ( #11 -10) Page Two of the North 1 /2 of said Section 6 to the Little Rock Air Force Base and the existing city limits of the City of Jacksonville; Thence Southwesterly along City limits of the City of Jacksonville, around Oak Ridge Ranch Subdivision, to the Easterly right of way of Highway 67/167 and the City limits of the City of Jacksonville, Thence Northerly along the City limits of Jacksonville to the South right of way line of Coffelt Road and Jacksonville City limits; Thence East along the South right of way line of Coffelt Road 1251.0 feet; Thence South 635.0 feet; Thence West 210 feet to the East line of the NW 1 /4 of the SE 1 /4, Section 4, T3N, R1OW; Thence North along the East line of said NW 1 /4 of the SE 1 /4 635.0 feet to the South right of way line of Coffelt Road; Thence continue East along the South right of way line of Coffelt Road to the Pulaski County /Lonoke County line and the East line of Section 4, T3N, R1OW; Thence North along the East line of said Section 4 to the NE corner of said Section 4; Thence East along the North line of said Section 4 to the SE corner of Section 33, T4N, R1OW and the point of beginning containing approximately 2178.21 acres more or less. Hwy 161 South Annexation A part of Section 1, T2N, R11W and Section 36, T3N, R11W, Pulaski County, Arkansas being more particularly described as follows: Beginning at the SW corner of the NW 1 /4 of the SW Y of Section 1, T2N, R11W; Thence East along the South line of the NW 1 /4 of the SW 1 /4 of said Section 1 to the SE corner of the NW 1 /4 of the SW 1/4 of said Section 1; Thence North along the East line of the NW 1 /4 of the SW 1 /4 of said Section 1 to the NE corner of the NW 1 /4 of the SW 1 4 of said Section 1; Thence East along the North line of the South 1/2 of said Section 1 to the SE corner of the SW 1 /4 of the NE 1/4 of said Section 1; Thence North along the East line of the SW 1/4 of the NE w; of said Section 1 to the NE corner of the SW 1 /4 of NE Y of said Section 1 and the City limits of the City of Jacksonville; Thence Northerly and Westerly along the City limits of the City of Jacksonville to the East line of the West 1 /2 of the West 1 /2 of said Section 1; Thence North along the East line of the West 1 /2 of the West 1 /2 of said Section 1 and along the East line of the West 1 /2 of the West 1 /2 of Section 36, T3N, R11W, to a point 300 feet South of the South East right of way line of Union Pacific Railroad; Thence Southwesterly, parallel to the Railroad right of way line to the West line of Section 1, T2N, R11W; Thence South to the SW corner of the NW 1 /4 of SW 1 /4 and the point of beginning containing 241.25 acres more or less. 000031 ORDINANCE NO, 1406 ( #11 -10) Page Three SECTION TWO: The question of annexation of the territories described herein shall be submitted to the electors qualified to vote on this issue at a Special Election to be held in conjunction with the General Election on Tuesday, November 2, 2010. The City Clerk shall immediately notify the Pulaski County Election Commission of such a question by forwarding a certified copy of this Ordinance No. 1406 ( #11 -10) to said Commission with a request that the question of annexation be placed on the ballot for said election. SECTION THREE: If, at such election, a majority of the qualified electors voting in such election shall vote for such annexation, the Mayor and /or his designated representatives(s) shall proceed to file the legal description contained herein and maps of the annexed areas with the Pulaski County Clerk, wherein the land lies, and with the Arkansas Secretary of State. The annexed properties as described herein shall be included within the corporate limits of the City of Jacksonville Arkansas, Thirty (30) days following the filing of the descriptions and maps with the Pulaski County Clerk or, in the event an action is timely filed within the Pulaski County Circuit Court contesting said annexation, on the date any final judgment of said Court becomes entered of record. If a majority of the qualified electors voting on the issue at the election vote against the annexation, this Annexation Ordinance shall be null and void. SECTION FOUR: If the annexation is approved and becomes final, the following municipal services shall be coordinated, extended, and /or supplemented to the described territories within the following time frames: SERVICE DATE Police Protection Immediately upon transfer from the PCSO with coordination and transfer to the Jacksonville Police Department. Fire Protection/ Immediate coordination of and supplementation of Emergency Services existing volunteer services with the Jacksonville Fire Department. Sanitation Coordinated transfer within Six (6) months of the effective date of the Annexation. Animal Services Coordination, supplementation, and implementation of such services. Code Enforcement Coordination, supplementation, and implementation of such services. 000032 ORDINANCE NO. 1406 ( #11 -10) Page Four SECTION FIVE: The ballots used at the Election of November 2, 2010, on the question of annexation of the territories described and reflected herein shall read essentially as follows: ❑ FOR annexation of the territories as described in Jacksonville Ordinance No. 1406 ( #11 -10). ❑ AGAINST annexation of the territories as described in Jacksonville Ordinance No. 1406 ( #11 -10). SECTION SIX: All Ordinances, parts of Ordinances, or previous actions taken by this City Council in conflict herewith are hereby repealed to the extent of such conflict. SECTION SEVEN: To provide more effectively for the health, safety, and welfare of our citizens and those in the affected territory described herein, an emergency is hereby declared to exist.
