RESOLUTION NO. 216 -78
A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE A QUITCLAIM
DEED TO PENNIE FRANKS; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville acquired certain property on the 16th
day of September, 1953, by Warranty Deed from Pennie Franks, described as follows,
to -wit:
The South Ten (10) Acres of the East Half (Ez) of the Northeast Quarter
(NE;) of Section Twenty -eight (28), Township Three (3) North, Range Ten
(10) West, together with the right of ingress and egress thereto and
therefrom over and along a strip of ground 20 feet in width extending
north from the property hereby conveyed along and adjacent to the west
line of the remaining property now owned by grantor herein and lying in
the said Eli NE; Sec. 28- T3N -10W.
WHEREAS, the said deed was subject to reversion in favor of Pennie Franks
if the property was not used for public services, and
WHEREAS, the said property has not been used for public services for many
years and should be re- conveyed to Pennie Franks.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE,
ARKANSAS, that:
SECTION 1: The Mayor and the City Clerk are hereby authorized to execute
a Quitclaim Deed to the above described property to Pennie Franks.
SECTION 2: This Resolution being necessary for the immediate preservation
of the public health, safety, welfare and morale of the citizens of the City of
Jacksonville, and emergency is hereby declared to exist and the above Resolution
shall be in full force and effect from and after the date of its passage and
approval.

Q U I T C L A I M D E E D
KNOW ALL MEN BY THESE PRESENTS:
That, City of Jacksonville, Arkansas, a municipal corpora-
' tion, Grantor, organized under and by virtue of the laws of the
State of Arkansas, by its Mayor and City Clerk, duly authorized
hereto by proper resolution of its City Council, for the consid-
eration of the sum of Ten and no /100 ($10,00) Dollars, in hand
paid by Pennie Franks, Grantee, the receipt of which is hereby
acknowledged, does grant, sell and quitclaim unto the said Grantee
and unto her heirs and assigns forever, all its right, title and
interest and claim in and to the following lands lying in Pulaski
County, Arkansas, to -wit:
The South Ten (10) acres of the East Half (E') of
the Northeast Quarter (NE%) of Section Twenty -eight
(28), Township Three (3) North and Range Ten (10)
West, together with the right of ingress and egress
thereto and therefrom over and along a strip of
groud 20 feet in width extending north from the
property hereby conveyed along and adjacent to the
west line of the remaining property now owned by
the grantor herein and lying in the said Ek NEB
Sec. 2 1 10W.
To have and to hold the same unto the said Grantee, Pennie
Franks, and unto her heirs and assigns forever, with all appur-
tenances thereunto belonging,
IN TESTIMONY WHEREOF, the name of the Grantor is hereunto
affixed by its Mayor and by its City Clerk, this gth day of

ACKNOWLEDGMENT

as the Mayor and City Clerk of the City of Jacksonville, Arkansas,
and stated that they had executed the foregoing Deed for the uses
and purposes therein mentioned and set forth.
