1476 ORDINANCE NO. 1476 (#7-2013)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURCHASE OF FOUR HUNDRED
TWENTY FIVE (425) NEW GARBAGE CONTAINERS FOR THE
JACKSONVILLE SANITATION DEPARTMENT;DECLARING A N EMERGENCY;
AND, FOR OTHER PURPOSES.
WHEREAS, the Sanitation Department is in need of additional garbage
containers for use by citizens; and,
WHEREAS, the Sanitation Department has previously purchased the same
containers used throughout the City for a rate of Fifty-three Dollars ($53.00) per
container. As a result, this is an opportunity to purchase the same garbage
containers at a reasonable cost to the Department, which will allow for continued
and improved sanitation collection for our citizens.
BE IT ORDAINED A N D ENACTED BY THE CITY COUNCIL OF THE CITY
OF JACKSONVILLE,ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of obtaining a
bulk amount of garbage containers for the Jacksonville Sanitation Department would
be costly, non-productive, and time consuming, making said competitive bidding
unfeasible and impractical.
SECTION TWO; Pursuant to ACA§ 14-58-303,competitive bidding
is hereby waived for the purpose of purchasing from the Sanitation Department's
Equipment Fund Four Hundred Twenty-five (425) new garbage containers for use
by the Sanitation Department. Authorization is hereby given to the Mayor and/or
his designated representative to execute necessary documents with River City
Hydraulics, Inc., of Sherwood, Arkansas, for a total sum of Twenty-five Thousand
Dollars ($25,000.00), with anticipated delivery within Thirty (30) days.
SECTION THREE: All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.

SECTION FOUR; This Ordinance, necessary for the Sanitation
Department to accommodate to the growth of the City and the health, safety, and
welfare of the citizens of Jacksonville, should be implemented immediately.
Therefore, an emergency is hereby declared, and this Ordinance shall be in force
and effect from after its date of passage.
