Mayor Reid called the meeting to order. Alderman Marshall Smith gave the Invocation. The standing audience participated in the "Pledge of Allegiance To The Flag. PRESENTATION OF MINUTES: Mayor Reid presented the minutes of Regular City Council Meeting held on Febraury 19, 1981, for study and later action at the next regular meeting. APPROVAL AND /OR CORRECTION OF MINUTES: Alderman Hughes moved, seconded by Alderman Abdin, to approve the minutes of Regular City Council meeting held on February 5, 1981. Approved by unanimous voice vote. MOTION CARRIED. CONSENT AGENDA: Alderman Hughes moved, seconded by Alderman Abdin to approve the monthly report from the Fire Dept. submitted by Chief Smart reflecting 36 alarms being answered and are estimated fire loss of $26,925.00 for said month. ROLL CALL and the following voted aye, Aldermen: Knight, Smith, Brooks, Hughes, Wilson, Durham, Fletcher, Abdin, Keaton and Williamson. Motion received 10 affirmative votes, 0 negative votes MOTION CARRIED. Alderman Hughes moved, seconded by Alderman Abdin to approve the monthly report from the Animal Control Dept. submitted by Insp. He stated the specs were not written correctly and because of this, he had to bid a larger engine, therefore, a higher price. The specs asked for a 305 cubic inch engine with a 4 barrel carburetor. Aclin Ford bid a 351 cubic inch engine with an injector type carburetor. Aclin felt PAGE THREE CITY OF JACKSONVILLE, ARKANSAS REGULAR CITY COUNCIL MEETING MARCH 5, 1981 they were out speced because Ford no longer makes a 305 engine or a 4 barrel carburetor. He felt, however, the 302 engine was equivalent but the specs did not specify "or equivalent, "' and could not bid the 302 engine. He asked the council to consider his company because the vehicles offered meets or exceeds the specs. Capt. Benny Tolbert addressed the council and stated he wrote the specs and did not mean to spec anyone out. He did not believe the vehicles Ford had bid could do the job the Police Dept. needed in a chase. Alderman Durham moved, seconded by Alderman Knight to reject all bids and set up a committee of five (5) people, one person from each dealership (3), one person from the Police Dept. and one person from City Hall, to establish specs and readvertise for bids. Approved by unanimous voice vote. MOTION CARRIED. NON- AGENDA ITEM: PUBLIC HEARING FOR SUNNYSIDE HILLS BLOCK GRANT PROJECT: Mayor Reid announced it was 8:00 p.m. and was time for the public hearing for the Sunnyside Hills Block Grant to begin. We would continue with the Council meeting immediately after. The hearing was to discuss changing the $50,000.00 for demolition of housing to $40,000.00 for rehabilitation and $10,000.00 for drainage. Mr. Don Manes, of Manes & Associates, explained the changing of monies would not effect the funding, and when we start to write the third year funding, if we desire to put the demolition back into the project we can. It has not been feasi abl e to buy the houses and demolish them but to buy them and repair them. There was no more discussion from the audience and Mayor Reid closed the public hearing at 8:05 p.m. PLANNING COMMISSION: Alderman Wilson questioned the compromise situation, if a decision had come about pertaining to the C-2 zoning change to C-1. Mr. Ben Rice, attorney for the property owners, stated his clients woulid not appeal the councils decision if they agreed on C -1 zoning. Alderman Wilson moved, seconded by Alderman Brooks, to place Ord. #2 -81 on first reading. (No vote) Alderman Keaton moved, seconded by Alderman Wilson to amend Ordinance to read "rezone from R -1 to C -1 . " ROLL CALL and the following voted aye, Aldermen: Knight, Brooks, Wilson, Fletcher, Keaton and Williamson. Aldermen: Smith, Hughes and Durham voted nay and Alderman Abdin abstained. Motion received 6 affirmative votes, 3 negative votes and 1 abstention. MOTION CARRIED. COMMENTS FROM THE AUDIENCE; Mr. Harl i e Jackson; 204 Brewer St.; stated it was the consensus of the neighborhood for the property to be left residential, ( to council meeting, Mr. Jackson had presented the City Clerk with two (2) petitions against rezoning. One petition had 87 signatures, the second petition had four (4) signatures of property owners adjacent to the property on Hwy. 161. The latter petition was notarized.) Mayor Reid acknowledged receipt of both petitions. PAGE FOUR CITY OF JACKSONVILLE, ARKANSAS REGULAR CITY COUNCIL MEETING MARCH 5, 1981 Mr. Gary Harden; 316 Brewer St . ; stated it should be left residential, it was not an established business district. Mr. Ben Rice, stated he was of the understanding a petition must be presented three (3) days before a council meeting and asked council members to not let these petitions have any bearing on their decision. Aldermen Keaton moved, seconded by Alderman Wilson, to read Ordinance as amended from R -1 to C-1. ROLL CALL and the following voted aye, Aldermen: Wilson and W i l l i a m s o n . Aldermen: Knight, Smith, Brooks, Hughes, Durham, Fletcher and Keaton voted nay and Alderman Abdin abstained. Motion recieved 2 affirmative votes, 7 negative votes and 1 abstention. MOTION FAILED. COMMENT FROM THE AUDIENCE: Mr. Jim Walker, owner of one parcel of property to be rezoned, stated his dissatisfaction of denial of rezoning request to the council. GENERAL: Alderman Knight summerized the letter from her to the City Engineer, Bill Owens and Street Superintendent, Robert Martin and his department for their work in the drainage problem areas of the city. Alderman Abdin moved, seconded by Alderman Durham to place Ordinance #5 -81 on FIRST READING. At this time, Mr. Jerry Crowley, Division Manager of GTE, addressed the council. He stated he had received a copy of the new ordinance on January 12, 1981, and has started collecting the new rate- from the customers already. Under the old ordinance, GTE paid tax payments quarterly, under the new ordinance the payments are monthly. The tax department has not had time to comply with the regulations of the new ordinance. It was the consensus of the council, to remain with the original Ordinance passed December 31, 1980, and give GTE people time to comply with the new ordinance. Alderman Abdin withdrew his motion and Alderman Durham withdrew his second. RESOLUTION #3-81: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, AMENDING FIRST YEAR SMALL CITIES PROGRAM" was introduced. Alderman Hughes moved, seconded by Alderman Smith to read resolution #3 -81. Approved by unanimous voice vote. MOTION CARRIED' Whereupon, Bertha Tipton, Mayor's Secretary read Resolution #3-81 in its entirety. Alderman Fletcher moved, seconded by Alderman Hughes to approve and adopt Resolution #3-81. MOTION CARRIED. Alderman Wilson moved, seconded by Alderman Brooks to accept the low bid on Engineering received from West -Tripp Engineers. Approved by unanimous voice vote. MOTION CARRIED. Mr. George West, of West -Tripp & Associates, addressed the council to withdraw his bid on Rehab Design due to circumstances, but would like to be considered if the bid is offered again. (Bond Engineers, who had bid on Rehab Design also, had withdrawn their bid earlier due to controversy.) Alderman Abdin moved, seconded by Alderman Fletcher to throw out all bids on the Rehab Design, and rebid and contract may be negociated at a later date. Approved by unanimous voice vote. Alderman Abdin stressed that when we have a bid opening, to open all bids the same date, time and place and if a bid comes in late, it will not be considered, NON- AGENDA ITEM: DRAINAGE BIDS: Alderman Abdin moved, seconded by Alderman Knight to place on agenda the drainage bids for Cherry and Laurel Streets, Delaney Property and Graham Road, Approved by unanimous voice vote. Alderman Hughes moved, seconded by Alderman Wilson, to waive informality and accept low bid from Jerry Smith, Const. on drainage proposal in Community Development. Approved by unanimous voice vote. Approved by unanimous voice vote. MOTION CARRIED. City Eng. Owens addressed council concerning dragline. He stated that to date we owe the dragline $20,460.00 and need $5,000.00 more to finish the work and make all drainage ditches work together. Alderman Wilson moved, seconded by Alderman Smith to approve the $5,000.00 needed to continue work process. Approved by unanimous voice vote. MOTION CARRIED. NON- AGENDA ITEM: Enclosed with each member's agenda packet, was a gas sheet with the amount of gas used by each garbage truck. Alderman Williamson asked each Alderman to take the sheet and look it over carefully and possibly start to think about a desil truck.
