A RESOLUTION FOR THE PURPOSE OF SETTING A PUBLIC I- EARING
ON A PETITION TO CLOSE AND VACATE A PORTION OF BROWN STREET,
COMMENCING AT THE SOUTH RIGHT OF WAY LINE OF VINE STREET AND
RUNNING SOUTH TO THE NORTH RIGHT OF WAY LINE OF POPLAR STREET.
WHEREAS, the owners of all lands adjoining that portion of Brown Street
as described in the caption hereof have this date filed a petition for closing and
abandoning said portion of Brown Street;
WHEREAS, notice of a public hearing must be given before any action
can be taken on said petition.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, That
Section 1. A public hearing on the petition to close and abandon that
portion of Brown Street which commences at the South right of way line of
Vine Street and runs South to the North right of way line of Poplar Street is
hereby set for Thursday, December 7, 1972 at 7:00 p.m.
Section 2. The City Clerk is directed to give public notice of said
hearing as required by law.
Section 3. This resolution is necessary for the preservation of the
public health, safety and welfare and an emergency is hereby declared to
exist.
PASSED and ADOPTED this .' L day of November, 1972.

PETITION TO VACATE AND ABANDON A PORTION
OF BROWN STREET IN JACKSONVILLE, ARKANSAS
KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, E. G. Middleton and Sallie V. Middleton, his wife,
are the record owners of Lot 1, Block 5, Sanders Addition to the
Town of Jacksonville, Arkansas;
WHEREAS, Royce Elliott and Mary Nell Elliott, his wife, are
the record owners of Lot 1, Block 2, Sanders Addition to the Town
of Jacksonville, Arkansas;
WHEREAS, John T. Haskins is the record owner of Lot 8, Block
2 and Lot 4, Block 5, both in Sanders Addition to the Town of
Jacksonville, Arkansas;
WHEREAS, each of the aforementioned persons acknowledges the
ownership as aforestated to constitute the ownership in full of
all abutting lots on that portion of Brown Street running North
and South between Vine Street and Poplar Street;
NOW, THEREFORE, we, the undersigned, certify that we are all
the owners of lots abutting on Brown Street in the City of Jack-
sonville, Arkansas, which runs South from the South right of way
line of Vine Street to the North right of way line of Poplar
Street, as shown on certified copies of the plat of said street
and adjoining property recorded in the Pulaski County Circuit
Clerk and Recorder's office attached hereto and incorporated herein
by reference, said portion of Brown Street not having been used
by the public as a street or alley for the past five (5) years;
petitioners submit that the public interest, convenience and
necessity will best be served by vacating and abandoning the
aforesaid portion of Brown Street in order to achieve the highest
possible land use.
