A RESOLUTION CALLING FOR AN ELECTION TO DETERMINE THE
QUESTION OF ANNEXING TO THE CITY OF JACKSONVILLE, ARKANSAS
CERTAIN CONTIGUOUS TERRITORY, DECLARING AN EMERGENCY AND
FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Jacksonville, Arkansas,
on the 18th day of November, 1971 passed Ordinance No. 248 annexing to said
City of Jacksonville, Arkansas certain lands deemed to represent the actual
growth of the municipality beyond its legal boundary, said lands being needed
by the City of Jacksonville, Arkansas for the extension of needed police regu-
lation, for improving the adaptability of certain industrial property for further
growth and development, for prospective municipal parks and recreation areas
and for other municipal purposes; and
WHEREAS, it is necessary to submit the question of annexing said
area to the legal voters in said area and in said City of Jacksonville, Arkansas;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, that:
Section 1. That it is hereby proclaimed that there shalt be submitted
to the legal voters of the City of Jacksonville, Arkansas and of the property
described in Ordinance No. 248 of the City of Jacksonville, Arkansas, at a
,
special election to be held in said city and in said area on January 18, 1972,
the question of the annexation of certain herein described territory contiguous
to said city and within the same county.
Section 2. That at said election on January 18, 1972 there shall be
provided a place on the ballot for each qualified elector voting in said election,
affording said electors an opportunity to vote either for or against the annexa-
tion of said area in substantially the following form:

Ordinance No. 248 proposes the annexation to the City of
Jacksonville, Arkansas of the South Jacksonville property,
more particularly described as follows, to -wit:
(1) That portion of Section 31, Township 3 North, Range
10 West, south and west of Bayou Meto, south and east of
the Missouri Pacific Railroad right of way and north and
west of State Highway 161;
(2) that portion of Section 36, Township 3 North, Range
11 West, south and east of the Missouri Pacific Railroad
right of way and north and west of State Highway 161 less
and except the following described property: (a) Starting
at the Northeast corner of Section 36, Township 3 North,
Range 11 West; thence along the east line of Section 36 on
a bearing of South 1 degree 50 minutes West, a distance
of 1,013.0 feet to a point in the center of the north or west
track of the Missouri Pacific Railroad, which point is lo-
cated 81.0 feet from the west abuttment of Missouri Pacific
Railroad Bridge No. 467, measured on the same bearing as
the railroad track; thence turning an angle to the right of 54
degrees 23 minutes with a bearing of South 56 degrees 13
minutes West along said center line of the railroad track a
distance of 2,494.2 feet to a point; thence turning an angle
to the left of 86 degrees 20 minutes with a bearing of South
30 degrees 07 minutes East a distance of 50.15 feet to a
point of beginning on the south right of way of the railroad.
From the point of beginning, formerly known as the northeast
corner Lot 28, "Cloverdale Gardens" (unrecorded) continue
on the bearing of South 30 degrees 07 minutes east, a distance
of 1,164.9 feet to a point formerly known as the southeast
corner Lot 28, "Cloverdale Gardens"; thence turning an angle
to the right of 79 degrees 49 minutes with a bearing of South
49 degrees 42 minutes West, a distance of 671.8 feet to a
point formerly known as the southwest corner Lot 29, "Clover-
dale Gardens "; thence turning an angle to the right of 91 degrees
33 minutes with a bearing of north 38 degrees 45 minutes West,
a distance of 1,244.6 feet to a point formerly known as the north-
west corner Lot 29, "Cloverdale Gardens"; thence turning an
angle to the right of 94 degrees 58 minutes with a bearing of
North 56 degrees 13 minutes East, a distance of 850.0 feet to
the point of beginning, said plot comprises some 21.0 acres,
more or less; (b) commencing at the northeast corner of said
Section 36; thence South 01 degree 50 minutes West along the
East line of Section 36, 1,013.0 feet to a point in the center
of the Missouri Pacific Railroad right of way, said point being
located 81.0 feet from the West abuttment of Missouri Pacific
Railroad Bridge No. 467; thence South 56 degrees 13 minutes
West along said center line of Missouri Pacific Railroad right
of way 2,494.2 feet; thence South 37 degrees 07 minutes East,
50.15 feet to the southerly line of said railroad right of way;
thence South 56 degrees 13 minutes West, 850.0 feet along said
southerly right of way line to the point of beginning; thence South
38 degrees 45 minutes East, 1,244.6 feet; thence South 49 de-
grees 42 minutes West, 680.0 feet, thence North 38 degrees 39
minutes West, 1,321.2 feet to the southerly right of way line of
Missouri Pacific Railroad; thence North 56 degrees 13 minutes
East along said southerly right of way line, 680.0 feet to the

point of beginning, containing 20.0 acres, more or less;
(c) that portion of the Southwest 1/4 of the Southwest 1/4
lying South and East of the Missouri Pacific Railroad right
of way;
(3) beginning at the intersection of the east line of the
Southwest 1/4 of the Southwest 1/4, Section 36, Township
3 North, Range 11 West with the south and east right of
way line of the Missouri Pacific Railroad, thence southeasterly
along said right of way line to its intersection with the south
line of the Northeast 1/4 of the Northeast 1/4 of the Northeast
1/4, Section 2, Township 2 North, Range 11 West, thence
south on the east line of the Southwest 1/4 of the Northeast
1/4 of the Northeast 1/4 a distance of 300 feet; thence north-
easterly parallel to the south and east right of way line of the
Missouri Pacific Railroad to the east line of the Southwest
1/4 of the Southwest 1/4, Section 36, Township 3 North, Range
11 West; thence north on said east line 300 feet to the point of
beginning;
(4) the Southwest 1/4 of the Northeast 1/4 of the Northeast 1/4,
and the Southeast 1/4 of the Northwest 1/4 of the Northeast 1/4,
Section 2, Township 2 North, Range 11 West;
(5) beginning at the intersection of the south line of the Southeast
1/4 of the Northwest 1/4 of the Northeast 1/4, Section 2, Town-
ship 2 North, Range 11 West with the north and west right of way
line of the Missouri Pacific Railroad; thence southwesterly along
said right of way line to the southwest corner of Section 2, Town-
ship 2 North, Range 11 West; thence north along the west line of
Section 2, Township 2 North, Ranga 11 West a distance of 300
feet; thence northeasterly parallel to the north and west right of
way line of the Missouri Pacific Railroad to the south line of the
Southeast 1/4 of the Northwest 1/4 of the Northeast 1/4, Section
2, Township 2 North, Range 11 West; thence east along said south
line 300 feet to the point of beginning;
(6) a portion of Section 1, Township 2 North, Range 11 West,
more particularly described as follows: beginning at the north-
east corner of the Northwest 1/4 of the Northwest 1/4, Section
1, Township 2 North, Range 11 West; thence south along the east
line of the Northwest 1/4 of the Northwest 1/4 850 feet; thence
south 87 degrees 25 minutes east 769.4 feet more or less to
Cloverdale Road; thence southwesterly along Cloverdale Road to
the southwest corner of Chastain's Gardens Subdivision, as des-
cribed in a certain plat recorded at Book 870, Page 521, of the
records of Pulaski County, Arkansas; thence south 38 degrees
19 minutes east 195.0 feet to the southeast corner of Chastain's
Gardens Subdivision, thence north 28 degrees 31 minutes east
544.0 feat to the northeast corner of Chastain's Gardens Subdi-
vision; thence north 53 degrees ::/minutes east 205.0 feet;
thence 36 degrees 30 minutes w 75.0 feet; thence 53 degrees
30 minutes east 500.0 feet; thence south 36 degrees 30 minutes
east 875.0 feet more or less to the north and west right of way
line of State Highway 161; thence northeasterly along said right
of way 625.0 feet more or less_to thewest line of the Northeast
1/4 of the Northeast 1/4, Section 1, Township 2 North, Range 11

West; thence north along said west line 440 feet more or
less to the north line of Section 1, Township 2 North,
Range 11 West; thence west along said north line 2640
feet more or less to the point of beginning;
(7) that portion of the Northeast 1/4 of the Northeast 1/4,
Section 1, Township 2 North, Range 11 West, lying north
and west of State Highway 161;
(8) that portion of the Northeast 1/4 of the Northeast 1/4,
Section 1, Township 2 North, Range 11 West, lying south
and east of State Highway 161;
(9) the Northwest 1/4 of the Northwest 1/4, Section 6,
Township 2 North, Range 10 West;
(10) that portion of the Southwest 1/4 of the Southwest 1/4,
Section 31, Township 3 North, Range 10 West, lying south
and east of State Highway 161;
(11) that portion of the Northwest 1/4 of the Southwest 1/4,
Section 31, Township 3 North, Range 10 West, lying south
and east of State Highway 161 and south of Bayou Meto;
(12) that portion of the Northeast 1/4 of the Southwest 1/4,
Section 31, Township 3 North, Range 10 West, lying south
of Bayou Meto;
(13) that portion of the Southeast 1/4 of the Southeast 1/4,
Section 36, Township 3 North, Range 11 West, lying south
and east of State Highway 161;
(14) part of the SE 1/4 of the NW 1/4 and part of the NE 1/4
of the SW 1/4 of Section 31, Township 3 North, Range 10
West, Pulaski County, Arkansas, lying north of Bayou Meto
and more particularly described as follows: Beginning at a
point on the East line of the NE 1/4 of the SW 1/4 of said
Section 31, 50 feet, more or less, south of the NE corner
thereof; thence South 40.8 feet along said East line; thence
S 40 degrees 27 minutes 30 seconds West 550 feet, more or
less, along a line 410 feet southeast of and parallel to the
centerline of Highway *161 to the center of Bayou Meto;
thence Westerly along the center of Bayou Meto to the South-
erly right of way line of Highway *161; thence North 40 de-
grees 27 minutes 30 seconds E 800 feet, more or less, along
said right of way line; thence S 49 degrees 32 minutes 30
seconds E 313.5 feet, more or less, to the point of beginning,
the tract containing 5.5 acres, more or less; and
(15) part of Section 31, Township 3 North, Range 10 West,
Pulaski County, Arkansas, more particularly described as
follows, to -wit: commence at the point of intersection of
the south city limits of the City of Jacksonville, Arkansas
and the west right of way line of Arkansas State Highway *161;
thence in a westerly direction along the south city limits line
of the City of Jacksonville, Arkansas to the point of intersec-
tion with the centerline of Bayou Meto; thence in a southeasterly
direction along the centerline of said Bayou Meto Creek to the

point of intersection with the westerly right of way line of
Arkansas State Highway *161; thence in a northeasterly
direction along said highway right of way line to the point
of beginning.
Section 3. That municipal officials and county and state election
officials shall do any and all things necessary in conducting said election as
aforesaid.
Section 4. That there is hereby found and declared to be an imme-
diate need for determining the question of the annexation of the aforesaid area
to the City of Jacksonville, Arkansas and it is therefore declared that an
emergency exists and this resolution being necessary for the immediate pre-
servation of the public health, safety and welfare, shall be in full force and
take effect immediately upon and after its passage.
