Accessory Building Maximum Square Footage Variance 313 Forest Glen Cove Petitioner: Keith Jakes 8 (plot plan included in packet) ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: October 10, 2022 6:00 p.m. – 6:15 p.m. ATTENDANCE: Commissioners: Ruple, Montgomery, and Chairman Brown were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Brown declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Ruple moved, seconded by Commissioner Montgomery to approve the regularly scheduled meeting minutes of September 12, 2022. MOTION CARRIED with Chairman Brown voting AYE. VARIANCE(S): a. Sign Package Variance 1815 North First Street No petitioner was present, therefore, this item of business was tabled. b. Accessory Building Maximum Square Footage Variance 111 Burroughs Road Chairman Brown opened the public hearing at approximately 6:01 p.m. Petitioner Charles Dare stated that he picked out a 60’x40’ pole barn, but when he went in to get a permit he was told it was over the limit. City Engineer Adam Whitlow clarified that Mr. Dare is requesting 2400 square feet, noting that this is the lot combination replat they looked at last month. He related that the entire lot is now approximately .91 acres, adding that the primary structure is a little over 1200 square feet. He pointed out that this property is about 1.5 miles north of the I-440/Highway 161 interchange and about a quarter of a mile from Jacksonville city limits. He stated that his staff does not comment one way or another on these issues, but he will provide technical information. He shared that the combined percentage of this proposed building with other accessory structures, would be right at 9% lot coverage. He shared that Code currently says 650 square feet is the largest, but there have been allowances in the past when people have nonstandard, larger lots. He confirmed that it is strictly the Board’s decision, adding that it does meet the side, rear, and front setbacks. Chairman Brown brought up that this property is not inside of a subdivision, but is out by itself. Engineer Whitlow showed the Board photos of an aerial view, a street view from Highway 161 looking toward the property, and a street view of the existing structure that looks toward where the building will be. When Commissioner Ruple asked what the purpose of this building will be, Mr. Dare responded that it will be a carport/garage to store vehicles. He confirmed that it will be adjacent to the house on the left. Commissioner Ruple pointed out that this building is going to be twice the size of the house, then asked if it will be used as living quarters. Mr. Dare replied no. He explained that the building is going to be metal and be the same color as the house. BOARD OF ADJUSTMENT REGULAR MEETING October 10, 2022 6:00 p.m. – 6:15 p.m. Engineer Whitlow and City Clerk Davitt confirmed that neither of their offices have received complaints regarding this request. Chairman Brown closed the public hearing at approximately 6:07 p.m. Commissioner Ruple moved, seconded by Commissioner Montgomery to approve a 2400 square foot accessory building at 111 Burroughs Road with the stipulation that it matches the existing primary structure. MOTION CARRIED with Chairman Brown voting AYE. c. Accessory Building Maximum Square Footage Variance 313 Forest Glen Cove Chairman Brown opened the public hearing at approximately 6:08 p.m. Petitioner Keith Jakes stated that he bought a lot adjacent to his property. He explained that it was an empty lot, adding that he wants to add a detached garage that matches the existing structure. He mentioned they had the property replatted into one lot and when they told the City it was going to be 1200 square feet, they were told they needed a variance before getting a building permit. He confirmed that the building will be brick like his house, be a two-car garage for his automobiles, and have cement foundation. He shared that he has been on this property for ten years, recalling that he had two empty lots on either side of him and the owners finally decided to start selling them, so he purchased one. City Engineer Adam Whitlow related that this was a combination of two lots being approximately 140’x160’, which is just over half an acre. He pointed out that the primary structure is just under 3,000 square feet, including the garage. He noted it meets all setbacks as proposed on the plot plan. City Clerk Davitt confirmed her office has not received any calls regarding this request. Chairman Brown closed the public hearing at approximately 6:11 p.m. Commissioner Montgomery moved, seconded by Commissioner Ruple to approve a 1200 square foot accessory building at 313 Forest Glen Cove as requested. MOTION CARRIED with Chairman Brown voting AYE. ADJOURNMENT: Without objection, Chairman Brown adjourned the meeting at approximately 6:15 p.m. MOTION CARRIED.
