Pa '(p 2/ A RESOLUTION FOR THE PURPOSE OF CLOSING AND VACATING GRACE STREET AS SHOWN ON .A PLAT RECORDED IN THE PULASKI COUNTY RECORDS AT BOOK FOUR (4) PAGE 330, BEING THE ORIGINAL PLAT OF THE GRACE BROWN ADDITION TO THE CITY OF JACKSONVILLE; AND ACCEPTING AS THE CORRECT RECORD, THE PLAT RECORDED AT PLAT BOOK FIVE (5), PAGE 64 OF THE OFFICIAL RECORDS OF THE CIRCUIT CLERK AND OFFICIO RECORDER OF PULASKI COUNTY, ARKANSAS, AS THE REVISED PLAT OF GRACE BROWN ADDITION AND SANDERS ADDITION TO THE CITY. OF JACKSONVILLE, ARKANSAS. WHEREAS, a certain plat described as the Plat of Grace Brown Addition to theCity of Jacksonville, Arkansas, being a part of the Southwest Quarter of the Southeast Quarter (S 4,SE *), Section Nineteen (19) Township Three (3) North, Range Ten (10. West, Pulaski County, Arkansas, was approved by the Jacksonville Planning Commission on the 2nd day of August, 1954, and filed for record in the Pulaski County Records on the 17th day of August, 1954, said plat showing thereon a certain fifty (50) foot public easement to be known as Grace Street; and - -- WHEREAS, a subsequent Plat revising the said Grace Lrimi Brown Addition, and platting the Sanders Addition, was approved 0 by the Jacksonville Planning Commission and accepted by the Jacksonville City Council on or after October 24, 1955; this being the intention of the subdivider, the Planning Commission and the City Council that said Revised Plat be accepted in lieu of the original Plat covered by Grace Brown Addition and that Grace Street be vacated and closed by the recording of the said Revised Plat, and; WHEREAS, the said Revised Plat was filed of record in Plat Record Book Five (5), Page 64, on the 15th day of December, 1955; and WHEREAS, the wording of the Revised Plat and Bill of Assurance was vague, leaving confusion in the minds of the persons holding interests therein, and in the minds of the public, as to the afore - mentioned Grace Street; and WHEREAS, the said Grace Street was never opened to the public; that the public has never had actual use of the said land, and all owners abutting said public easement have petitioned the Planning Commission and City Council to close and vacate that street originally platted as Grace Street; and WHEREAS, the Planning Commission has recommended that the City Council take necessary action to correct the situ- ation presently existing in this matter; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVIT,TF, ARKANSAS, THAT: SECTION 1. That the City Council does hereby ratify and confirm the acceptance of the Revised Plat of Grace Brown Addition and Sanders Addition to the City of Jacksonville, Arkansas, recorded at Book Five (5), Page 64, of the Records of Pulaski County, Arkansas; and SECTION 2. That the City of Jacksonville, Arkansas, by such ratification and confirmation hereby releases, vacates and abandons all its rights, together with the right of the public generally in and to the street designated as Grace Street on the original Plat of Grace Brown Addition to the City of Jacksonville, Arkansas, recorded in Book Four (4), Page 330 of the Records of Pulaski County, Arkansas; and Section 3.
