0082 RESOLUTION NO. ; Whereas W. W. Nixon, Jr., and B. F. Thompson, hereinafter referred to as Builders did during the years 1963 and 1964 proceed with the development of streets and utilities on Laurel, Cherry and North Oak Streets and the construction of 44 houses in accordance with the laws of the City of Jacksonville after consultations with the Mayor, and with his agreement, And whereas all of these utilities were completed and streets graded with gravel added to a depth of six inches on part of Cherry Street and three inches on the remainder, And whereas Builders did petition the Planning Commission in January, 1965 to waive the requirements of the City's Subdivision Ordinance No.154 which was enacted in 1\104 , 1964, after Builders were committed on the type and cost of improvements in this area; said waiver request being denied by the Planning Commission, • And whereas Ordinance No. 154 under Section 6, and under Section 7, paragraph 8.3 provides for the City Council to allow the development and completion of this area in accordance with the agreement between the City and the Builders, said provisions to be enacted by the majority vote of the members present at a City Council meeting; Now THEREFORE be it resolved that Builders be permitted to complete the development of this area as they had agreed with the City to do as evidenced by the work done in 1963 and 1964. Said completion to consist of the construction of houses on the remaining 18 lots, an adequate drainage structure being built by Builders at the ditch corssing Laurel Street and the existing streets receiving six inches of crushed stone base and a "double shot treatment" with•chi s for surfacing. The addresses of the 18 lots being 200 204, 205 208 209 212, 213 216, 217, 220, - - - 221, and 224 Laurel and 4 16, 420, 4 24, 4 28, 432, and 436 North Oak. — — APPROVED AND ADOPTED THIS the /tr day of APRIL, 196 ` Alf �a��a� t t
