0681 RESOLUTION NO. 681 (#07-2012) A RESOLUTION AUTHORIZING AND DECLARING A MORATORIUM UPON ENTRY AND USE OF MOBILE/MANUFACTURED HOMES MANUFACTURED PRIOR TO 1976 AND/OR ANY OTHER MOBILE HOME(S) UNLESS SAID HOME(S) MEET OR EXCEED CURRENT CONSTRUCTION STANDARDS OF THE ARKANSAS MANUFACTURED HOME COMMISSION (AMHC) AND ALL OTHER APPLICABLE PROVISIONS OF LOCAL, STATE, AND FEDERAL LAWS, RULES, AND REGULATIONS; PROVIDING FOR CERTAIN OTHER MATTERS RELATING THERETO;DECLARING AN EMERGENCY;AND, FOR OTHER PURPOSES. WHEREAS, the City has a number of mobile/manufactured homes, with many having been manufactured Fifty to Sixty (50-60) years ago. As a result, a number of said home(s) within the City are aging and non-compliant with current standards due to a lack of maintenance by owner(s)/tenant(s), and some mobile/manufactured home(s) have attempted to be brought into the City in non-compliant condition(s) from surrounding communities. Such conditions have and create additional problems and unnecessary expenses for the City and create unsightly and hazardous housing for our citizens, all of which is not in compliance with the terms of the City's Affordable Housing Overlay District (AHOD), created by this City Council in 1998; and, WHEREAS,to prevent continued deterioration of affordable housing available to citizens of Jacksonville, the Council seeks to develop and obtain detailed plans addressing such non-compliant home(s), with appropriate public input, to insure such placements throughout the City are appropriate, long-term in nature, beneficial for both citizens and business(es) alike, and continue to meet the goals established by the City's AHOD. As a result, City officials, including the Jacksonville Planning Commission, hereby request a moratorium on entry of and continued use of any mobile/manufactured home(s) manufactured prior to 1976 and/or any other mobile home(s) that do/does not meet or exceed current construction standards of the AMHC into the City until the expiration of Six (6) months or until the City Council completes more definitive plans and provisions as to continued use of aging mobile/manufactured home(s) within Jacksonville and City officials have sufficient time to analyze and adequately address the issue of appropriate affordable housing units within the City of Jacksonville. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE,ARKANSAS, THAT: SECTION ONE; A moratorium is hereby enacted within the City of Jacksonville prohibiting entry of and/or continued use of mobile/manufactured home(s) manufactured prior to 1976 and/or other mobile home(s) that do not meet current local, state, and federal construction and housing regulations and standards is hereby declared for a minimum period of Six (6) months or until the City Council provides more definitive plans as to proposed changes to the continued use of and entry of such mobile/manufactured home(s) in the City. City officials are hereby tasked with conducting a thorough analysis of aging non-compliant home(s) to adequately address protection of the citizens and balancing such with the need for affordable housing within the City of Jacksonville. The Council does so to allow for development of definitive plans Resolution No. 681 (#07-2012) Page Two for any modifications to existing regulations and requirements in the City of Jacksonville so as to avoid and prevent continued inappropriate use of and/or inappropriate placement of such housing unit(s) in conflict with established goals and plans to allow and provide for affordable housing. The Council believes that doing so is conducive to good planning for continued organized development and growth of Jacksonville. SECTION TWO; The Mayor of the City of Jacksonville, Arkansas, is authorized to execute such writings and take such actions as may be appropriate to carry out the terms of this Resolution. Action heretofore taken by the Mayor and/or his authorized representative(s) consistent with the purposes of this Resolution is hereby ratified and approved. SECTION THREE: It has hereby found that a moratorium for a minimum of Six (6) months is required for approval of the use of and entry of mobile/manufactured home(s) manufactured prior to 1976 and/or other such home(s) that do not meet current local, state, and federal construction and housing regulations and standards into the City of Jacksonville is plainly in the interest of the City. Thus, passage of this Resolution is essential to the proper development of areas of the City included in the AHOD. Therefore, it is hereby declared that an emergency exists and this Resolution, being necessary for the immediate preservation of public health and safety, shall take effect and be enforced from and after its adoption. SECTION FOUR: Any and all other Resolutions in conflict herewith are hereby repealed to the extent of said conflict. This Resolution shall be in effect from and after its date of passage.
