Side Yard Setback Jaxon Terrace PH 14A Petitioner: Dickie Jones Representative: Bond Engineering 4-5 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: December 14, 2020 6:00 p.m. – 6:14 p.m. ATTENDANCE: Commissioners: Ruple, Montgomery, Hall and Chairman Brown were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Brown declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Ruple moved, seconded by Commissioner Montgomery to approve the regularly scheduled meeting minutes of August 20, 2020. MOTION CARRIED. VARIANCE(S): a. Accessory Building Square Footage Variance 2405 Estates Court Chairman Brown opened the public hearing at approximately 6:01 p.m. Petitioner Phillip Carlisle present via Zoom. Mr. Carlisle explained that he is proposing to build a 25’ X 50’ accessory building to house his boat. He stated that his building would meet all City codes and his subdivision bill of assurance. Public Works Director Jim Oakley stated that the City has no objections as long as it meets City building code and the bill of assurance. He pointed out that the property consists of 4 acres, so the requested size is not an issue. Mr. Carlisle confirmed that his property is slightly less than 5 acres. He then answered Commissioner Hall that most of the accessory buildings in his subdivision are about the same size. He then noted that one accessory building is a large two car garage with an apartment on top. Commissioner Ruple moved, seconded by Commissioner Montgomery to approve the square footage variance regarding an accessory building at 2405 Estates Court as requested. MOTION CARRIED. Chairman Brown closed the public hearing at approximately 6:05 p.m. b. Side Yard Setback Jaxon Terrace PH 14A Chairman Brown opened the public hearing at approximately 6:06 p.m. Mr. Aaron Robinson of Bond Engineering, as petitioner representative, explained that when they designed this phase of the subdivision it was designed with R-1 zoning setbacks. He related that when they got to the final plat stage, it was determined that the property was actually R-0, saying that the lot lines had to be adjusted. He explained that the difference between an R-1 and an R-0 is that R-1 will allow for 60’ at the building line and an R-0 allows for 70’. He stated that they had to move the lot line between lots 9 and 10 further to the east, which took up part of lot 9 in order to make lot 10 have a 70’ wide building line. He added that in doing that they do not meet the 70’ building line on lot 9, he stated that they are asking to get the 70’ reduced and have a 15’ side yard setback instead of 25’ parallel to DeQuincy Road. BOARD OF ADJUSTMENT REGULAR MEETING December 14, 2020 6:00 p.m. – 6:14 p.m. He noted that the driveway will have to access Rope Trail off of DeQuincy instead of a side drive. Public Works Director Jim Oakley stated that they had confirmed with Mr. Robinson when the lot lines were moved that the narrower lot would not be an issue. He then added that he would not want it to become a habit that side lot lines are reduced to 15’. He stated that it will work as Mr. Robinson has depicted, but he would not want this to become an ordinary issue. Chairman Brown issued concerns regarding the driveway and Public Works Director Jim Oakley confirmed with Mr. Robinson that both lots 9 and 10 would load off of Rope Trail. Public Works Director Jim Oakley then noted that lot 8 could experience some sight impairment by reducing the setback for lot 9. He explained that if the driveway were to load on the left side of the lot that would offer a greater sight view. Mr. Robinson stated that lot 8, just because of the way that DeQuincy Drive is, they will want that driveway on the uphill side, which will be between lots 7 and 8. He explained that if you put the driveway on the low side you will have to use more fill just to get the driveway into the garage. He stated that the driveway will be on the uphill side of lot 8. He then stated that he would be drawing the plot plans for those lots, ensuring Public Works Director Jim Oakley that the City would want the driveway on that side because if it were between lot 8 and 9 it would have to be closer to the house. Public Works Director Jim Oakley concurred saying that he would like to have the driveway between lots 7 and 8. Mr. Robinson concurred. Commissioner Hall moved, seconded by Commissioner Montgomery to approve the side yard setback to 15’ for Lot 9 and contingent that Lot 8’s driveway be placed between lots 7 and 8. MOTION CARRIED.
