A RESOLUTION APPROVING AND GRANTING
AUTHORIZATION TO MAYOR JOHNSON AND OTHER
OFFICIALS TO ENTER INTO PROPOSED ADJUSTMENT
PLANS FOR JACKSONVILLE WASTEWATER UTILITY FOR
THE RELOCATION OF SANITARY SEWER MAIN FACILITIES
(JP WRIGHT LOOP ROAD BRIDGE, STATE PROJECT
#061527); AND, FOR OTHER PURPOSES.
WHEREAS, it has been determined that a City -Utility Relocation Agreement
between the City of Jacksonville and Jacksonville Wastewater Utility is necessary in
order to make city street improvements and relocate existing facilities, as described
in the attached Exhibit.
WHEREAS, an agreement covering the eligible reimbursable adjustment
costs between the City of Jacksonville and Jacksonville Wastewater Utility has been
prepared by the Arkansas Department of Transportation and is attached hereto.
WHEREAS, this agreement is governed by all applicable State and Federal
laws, rules, and regulations including the Arkansas State Highway Commission
Utility Accommodation Policy adopted by Commission Minute Order 2010-146 as
amended and supplemented, the Federal Aid Program Guide on Utility Adjustments
and Accommodation on the Federal Aid Highway Projects as amended and
supplemented, and the provision of 23 CFR §645 as amended and supplemented.
WHEREAS, after consideration and negotiation, it is hereby found that it is
in the best interest of the City to enter into a City -Utility Relocation Agreement
between the City of Jacksonville and Jacksonville Wastewater Utility
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor, City Clerk, and other designated officials
of the City of Jacksonville, Arkansas, are hereby authorized to enter into a City -
Utility Relocation Agreement (attached hereto) between the City of Jacksonville and
Jacksonville Wastewater Utility. The City Council recognizes and agrees that doing
so will benefit the City of Jacksonville and its citizens.
SECTION TWO: The Mayor, City Clerk, and designated officials are
hereby authorized and directed to execute all appropriate agreements and contracts
necessary for the development a City -Utility Relocation Agreement between the City
of Jacksonville and Jacksonville Wastewater Utility.

—_ SECTION THREE: Any other Resolutions in conflict herewith are hereby
repealed to the extent of said conflict. This Resolution shall be in effect from and
after its date of passage.
