A RESOLUTION IN SUPPORT OF AND AUTHORIZING
EXECUTION OF SALE DOCUMENTS FROM THE CITY OF
JACKSONVILLE FOR CERTAIN REAL PROPERTY DESCRIBED
HEREIN (GENERAL LOCATION - 110 JAXON CIRCLE AND 105
WEST AVE, IN EXCHANGE FOR 128 GALLOWAY CIRCLE);
AND, FOR OTHER PURPOSES.
WHEREAS, the real property described on the attached Exhibit A and B is
property owned by the City of Jacksonville; and,
WHERES, the real property described on the attached Exhibit C is property
owned by Chris Garnet; and,
WHEREAS, because said property described on the attached Exhibit A and B
has received an acceptable Offer & Acceptance, and the Purchaser intends to
improve the property, it is in the City's best interests to exchange said property for
the property currently owned by Chris Garnet, described on the attached Exhibit C.
As a result, certain City officials must be authorized to develop and execute the
appropriate and required documents for the purchase of City -owned property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor and City Clerk of the City of
Jacksonville, Arkansas, are hereby authorized to execute any and all documents for
the sale of, real property described in Exhibit A and B, and subsequently execute
documents related to the purchase of real property described in Exhibit C. The City
Council recognizes and agrees that doing so will, hopefully, benefit both Chris
Garnet and the City.
The Council hereby authorizes Mayor Johnson, City Clerk Davitt, and City
Attorney Friedman to execute and complete the appropriate documents required to
approve the purchase and sale of the property more particularly described in Exhibit
A, B, and C between the City and Chris Garnet.
SECTION TWO: Any and all other Resolutions in conflict
herewith are hereby repealed to the extent of said conflict. This Resolution shall be
in effect from and after its date of passage.
