21 MAR 22CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING MARCH 22, 2021 6:30 P.M. – 6:52 P.M. OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in a regular session on March 22, 2021. Vice Chairman Brown opened the meeting at approximately 6:30 p.m. expressing appreciation to those in attendance. ROLL CALL: Commissioners Mike Dietz, William Montgomery, Billy Hall, Jim Moore, Jeff Twitty, Greg Bollen, Vice Chairman Dan Brown were present and answered ROLL CALL. Vice Chairman Brown declared a quorum. PRESENT (7) with Chair, ABSENT (2). Chairman Stroud and Commissioner Vivian Brittenum were absent. CORRECTION AND/OR APPROVAL OF MINUTES: Commissioner Twitty moved, seconded by Commissioner Bollen to approve the minutes of December 14, 2020 as presented. MOTION CARRIED. PUBLIC HEARING(S): a. REZONING 1208 Military Road from R-1 to R-3 Petitioner Joseph Yagos/Crazy Horse Properties Vice Chairman Brown opened the public hearing at approximately 6:31 p.m. Mr. Yagos stated that he has a buyer for the property but it needs to be R-3 as a condition of the purchase. He then related that if the proposed buyer does not buy the property then Mr. Yagos would be interested in developing the property for duplexes or apartments. He then explained that the property is currently surrounded by apartments. Public Works Director Jim Oakley stated that the City does not have any issues with the property being rezoned to R-3. Commissioner Moore concurred that the area is mostly apartments and further development of apartments would be a good use of the property. Council Member Dietz agreed it would be a good use of the property. He noted that currently there are very few rental properties available in Jacksonville. In response to a question from Commissioner Hall, City Clerk Davitt responded that there had been no calls of concern or objection to her officer and Public Works Director Jim Oakley concurred the same. Public Works Director Jim Oakley noted that the property had been properly posted. With no one to speak in opposition, Vice Chairman Brown closed the public hearing at approximately 6:36 p.m. Council Member Dietz moved, seconded by Commissioner Twitty to approve the rezoning of 1208 Military Road from R-1 to R-3. MOTION CARRIED. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING MARCH 22, 2021 6:30 P.M. – 6:52 P.M. b. CONDITIONAL USE 8315 Hwy 161 C-2 retail use in a C-4 zoning Vice Chairman Brown opened the public hearing at approximately 6:36 p.m. Public Works Director Jim Oakley stated that the City has no issues with the development of a Dollar General Store in this area. Several of the Commissioners agreed that it would be a good location for the store. In response to a question from Commissioner Moore, Engineering Tech Mylissa Griggs responded that even though a good portion or even all of it may be located within the floodplain that does not preclude the property from being developed. She pointed out that the City ordinance calls for 2 feet above the base flood elevation for the finished floor and any servicing equipment and that is what the developer has proposed. She noted that they would have to submit the floodplain development permit prior to the City of Jacksonville issuing a building permit. With no one to speak in opposition, Vice Chairman Brown closed the public hearing at approximately 6:38 p.m. Commissioner Moore moved, seconded by Commissioner Hall to approve the conditional use of C-2 regarding a Dollar General Store in a C-4 zone addressed as 8315 Hwy. 161. MOTION CARRIED. REQUEST TO APPROVE PLAT(S): FINAL PLAT Tract 3, JJ Kitchen Subdivision No. 2 Project Manager, Sebrina Ricks of Blew & Associates, related that they are combining two tracts into a one lot Subdivision in order to facilitate the development as part of the City’s requirements. She then noted that they have also submitted their site plan to the City. She stated that they have met all City requirements outside the parking requirement which they have received a waiver. She stated that the property is located in flood zone A-E and has a base flood elevation of 250 and their proposed finished floor elevation is proposed at 252.2; meeting the current City required 2’ difference in the flood elevation. She noted that the store is proposed to 2,640 square feet with 30 parking spaces, the wooden dumpster enclosure would be to the rear of the site as well as wooden privacy fencing along the south and west sides of the site. Commissioner Moore complimented the developments of Dollar General and stated that he was glad to see the installation of privacy fencing regarding the adjacent residential properties. In response to a question from Commissioner Montgomery, Ms. Ricks stated that 30 parking spaces is typical for a standard size Dollar General. CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING MARCH 22, 2021 6:30 P.M. – 6:52 P.M. Architect Marcus McNee answered that the site is designed that an 18-wheeler truck will pull into the front drive aisle and then backing into the rear receiving area. He noted that all the maneuvering of the 18-wheeler would be on the Dollar General property. Council Member Dietz moved, seconded by Commissioner Montgomery to approve the Final Plat of Tract 3, JJ Kitchen Subdivision No. 2 as presented. MOTION CARRIED. BUILDING PERMIT(S): SITE PLAN 8315 Hwy. 161 Tract 3, JJ Kitchen Subdivision No. 2 Engineering Tech Mylissa Griggs stated contingencies requested by Public Works: 1) payment in lieu for sidewalk construction. She explained that this development is located far into the southern end of the City and there are no other sidewalks in the area, adding that Public Works Director Jim Oakley is okay with that contingency and will work up an estimate for the in-lieu payment. 2) drainage is currently being reviewed by Public Work’s consulting engineering firm so they are asking for a contingency upon approval of the drainage plan. In response to a question from Commissioner Moore, Public Works Director Jim Oakley stated that the Fire Marshal would review the plans before a building permit is issued. Commissioner Bollen moved, seconded by Council Member Dietz to approve the site plan for 8315 Hwy. 161 contingent on the afore listed contingencies 1) in lieu payment for sidewalk construction, 2) approval of drainage study, with review and approval by Fire Marshal.
