Maximum Square Footage Variance 407 Cypress Court Petitioner: Eric McCleary 4-5 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: September 9, 2019 6:45 p.m. – 6:57 p.m. ATTENDANCE: Commissioners: Ruple, Gregory, Brown, and Acting Chairman Moore were present. City Attorney Friedman was also present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Acting Chairman Moore declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Ruple moved, seconded by Commissioner Gregory to approve the regularly scheduled meeting minutes of August 12, 2019. MOTION CARRIED with Chair voting AYE. Commissioner Brown arrived at approximately 6:45 p.m. DEVIATION IN AGENDA: VARIANCE(S): b. Maximum Square Footage Variance 407 Cypress Court Acting Chairman Moore opened the public hearing at approximately 6:45 p.m. Petitioner Eric McCleary stated that originally when the accessory building was laid out it was not done correctly so another 2’ had to be added to each end, which meant the building went from 650 square feet to 725 square feet. He related that he plans to brick the one-story accessory building so that it would match the exterior of his home. Public Works Director Jim Oakley related that the accessory building does meet with City setback requirements. He then pointed out that the lots in this Subdivision are approximately one-acre each offering exceptionally large yards, saying that there is plenty of room for the building and it would not look out of place. In response to a question from to from Acting Chairman Moore, Mr. McCleary stated that he is not aware of the bill of assurance being active. He offered that some of his neighbors have constructed large accessory buildings. There were no objections from the audience. Acting Chairman Moore closed the public hearing at approximately 6:50 p.m. Commissioner Ruple moved, seconded by Commissioner Brown to approve the maximum square footage variance of 725 square feet at 407 Cypress Court as requested. MOTION CARRIED. a. Maximum Square Footage Variance 5400 Ridge Road Acting Chairman Moore opened the public hearing at approximately 6:51 p.m. Petitioner Richard Engel explained that currently they have a detached two-car garage that is all brick and matches the exterior of their home. He related that his father-in-law recently passed and he inherited his wood working equipment, explaining that he wants to extend the two-car garage to make it a three-car garage so that he will have a separate work area that would be heated and cooled to do wood working. He stated that he would use the same brick as the home and existing garage. BOARD OF ADJUSTMENT REGULAR MEETING September 9, 2019 In response to a question from Commissioner Ruple, Mr. Engel stated that there is a stream in-between the road and the building. He then answered that the building would be approximately 5 or 6 feet from the stream. He then added that this building is not near any easements. Acting Chairman Moore noted that with the layout, there is actually more room than it appears, saying that they have a good amount of space before getting into the dedicated easement. Public Works Director Jim Oakley related that he feels the 25’ dedicated easement to the rear is a half street improvement easement. Mr. Engel stated that the stream is really a run-off, which flows when there is rain. Acting Chairman Moore clarified that the building would be a total of 936 square feet with the addition of the requested 360 square feet. No one from the audience objected. Acting Chairman Moore closed the public hearing at approximately 6:55 p.m. Commissioner Ruple moved, seconded by Commissioner Brown to approve the maximum square footage variance at 5400 Ridge Road as requested. MOTION CARRIED. ADJOURNMENT: Without objection, Acting Chairman Moore adjourned the meeting at approximately 6:57 p.m. MOTION CARRIED.
