APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting of August 8, 2016 1 3. VARIANCE REQUEST(S): Building Line Setback Variance #1 Paradise Park Road Petitioner: Poloplaz & Air Tech Coatings Representative: Bond Engineering (letter, survey, and site plan Included in packet) ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: November 14, 2016 6:30 p.m. – 6:41 p.m. ATTENDANCE: Commissioners: Scholl, Healey, Higgins and Chairman White were present. City Attorney Bamburg and City Engineer Whisker were also present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman White declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Healey moved, seconded by Commissioner Higgins to approve the regularly scheduled meeting minutes of August 8, 2016. MOTION CARRIED. VARIANCE(S): Building Line Setback Variance #1 Paradise Park Road Chairman White opened the public hearing at approximately 6:30 p.m. Mr. Tommy Bond of Bond Engineering related that he would be representing Poloplaz & Air Tech Coatings owned by Mr. Mac Hogan. He stated that the company has been very successful and needs a new warehouse. He reviewed the location of the proposed building noting that Mr. Hogan acquired what was once church property and is now proposing to expand his business. He stated that the new warehouse would be located in-between the small storage building to the rear and the fence line adjacent to AGL properties. He then noted that the AGL entrance is a private drive and Paradise Park Road leads to the public lake. He added that Mr. Hogan owns both side of Paradise Park Road down to where the City’s property starts. He related that the construction would not be possible without variances. He stated that the building would front Paradise Park Road, adding that currently Mr. Hogan is using the old church building as a research and development center for his paint company and the other building is used for maintenance. He related that Mr. Hogan covered the church building in gray metal to match his other buildings located on the property, adding that the property has a great appearance. City Engineer Whisker related that the company has created an innovated covering for basketball and volley ball courts, which is being used by the NBA and is a required cover. He added that courts being built in China are having shipping containers of this product imported. He noted that the business is doing well and they need the warehouse space for shipping purposes. He stated that the property fronts Redmond Road and Paradise Park Road, adding that he had spoken with the Fire Marshal who did not see any reason not to proceed with the variances. He noted that setbacks usually have to do with fire codes but Mr. Hogan owns the land to the north and south, adding that the City does not see a reason not to grant the variance. Discussion ensued regarding the orientation of what is considered the property frontage. City Engineer Whisker stated that he considers Redmond Road to be the property frontage, adding that Mr. Bond believes it to be Paradise Park Road because Poloplaz goes back and forth across the Road so they treat Paradise Park Road as the front. He added that for the City’s purposes the front is Redmond Road. Mr. Bond noted that the only adjoining property is AGL. BOARD OF ADJUSTMENT REGULAR MEETING November 14, 2016 6:30 p.m. – 6:41 p.m. City Engineer Whisker then answered Chairman White that parking is not an issue, since this is only a warehouse facility for his product. He went on to say that there is a waterline that currently runs underneath the property but the Water Department will have to make those decisions on how to work that out. He then added that the plan is to remove the line so that it is not an issue. Mr. Bond clarified that when the request was submitted the Water Department went out to the property and found a 12” waterline, adding that the owner was not aware there was a waterline. He stated that there is no need for one but evidently it has been there for 20 plus years so there is an easement by prescription. He stated that several options have been proposed to the Water Department to resolve the issue, adding that they have not yet submitted an answer. He stated that one option is to relocate the line, while another is that there is a new line that on the side of the property making this line able to be disconnected. City Engineer Whisker then answered Chairman White that any issues other than setback would be a consideration for the Planning Commission during the building permit stage. Commissioner Healey moved, seconded by Commissioner Scholl to approve the setback variance at #1 Paradise Park Road as requested. MOTION CARRIED. Chairman White closed the public hearing at approximately 6:41 p.m. ADJOURNMENT: Without objection, Chairman White adjourned the meeting at approximately 6:41 p.m. MOTION CARRIED.
