APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting of February 8, 2016 1-2 3. VARIANCE REQUEST(S): Front and Rear Yard Setback Variance 40 Grace Street Petitioner: Donald Toennies 3-4 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: March 14, 2016 6:30 p.m. – 6:35 p.m. ATTENDANCE: Commissioners: Ronnie Higgins, Art Brannen, Virgil Healey, and Chairman Rick White were present. City Attorney Bamburg and City Engineer Whisker were also present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Rick White declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Brannen moved, seconded by Commissioner Higgins to approve the regularly scheduled meeting minutes of February 8, 2016. MOTION CARRIED. VARIANCE(S): 40 Grace Street front and rear yard setbacks Chairman White opened the public hearing at approximately 6:31 p.m. Mr. Don Toennies stated that the received the home from the City of Jacksonville in a land swap, noting that he gave the City a lot at 104 Galloway Circle. He explained that the survey showed that the house is over the front and rear yard setbacks. He stated that it is over 1’ in the rear and 2’ in the front. He added that he would need a variance in order to be able to sell the house, noting that the house has been there for 50 years. City Engineer Whisker concurred that the house does exceed the front and rear yard setbacks set by Code. He noted that this is the only property on Grace Street, explaining that all other buildings face the streets perpendicular to Grace Street. City Attorney Bamburg related that the property was donated to the City in 2015 through a mortgage company, explaining that the property was in default and the mortgage company did not want the property so it was donated to the City. He stated that Mr. Toennies owned property that was desired by the City so a property swap was done, explaining that no one at the time was aware of issues with the placement of the house. He concurred that the house has been built since 1974. Commissioner Healey moved, seconded by Commissioner Brannen to approve the front and rear yard setback variances at 40 Grace Street as requested. MOTION CARRIED.
