Rear Yard Setback 507 Jessica Court Petitioner: Tahji & Takka Robinson 5-6 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: March 9, 2015 6:30 p.m. – 6:44 p.m. ATTENDANCE: Commissioners: Vergil Healey, Alderman Howard, and Chairman Moore were present. City Attorney Bamburg and City Engineer Whisker were present. ______________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Moore declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Alderman Howard moved, seconded by Commissioner Healey to approve the regularly scheduled meeting minutes of January 12, 2015. MOTION CARRIED with Chair voting AYE. VARIANCE(S): a. Sign Variance 1701 T.P. White Drive for Gwatzilla Wash & Lube Chairman Moore opened the public hearing at approximately 6:31 p.m. Mr. Bradley West, Marketing and Public Relations Manager for Gwatney Chevrolet explained the request is for a sign package being proposed for the wash and lube facility they are currently constructing at 1701 T.P. White Drive. In response to a question from Chairman Moore, Mr. West answered that it would not be a flashing sign, but would be neon backlit with high efficiency lighting on both the front and side building signs. City Engineer Whisker informed the Board that the sign is larger than what is allowed by Code. He explained that Code allows 200 square foot per street frontage, pointing out that the building has two street frontages so they are allowed two signs and both are over 200 square feet. He concurred with Chairman Moore that the sign on the west wall is 295 square feet over the allowance and the one on the other wall is approximately 104 square feet over. With no one to speak in opposition, Chairman Moore closed the public hearing at approximately 6:34 p.m. Commissioner Healey moved, seconded by Alderman Howard to approve the sign package variance as requested for Gwatney Chevrolet Gwatzilla Wash and Lube at 1701 T.P. White Drive. MOTION CARRIED with Chair voting AYE. b. Rear Yard Setback Variance at 507 Jessica Court Chairman Moore opened the public hearing at approximately 6:35 p.m. Homeowner Tahji Robinson explained that he is requesting a rear yard setback variance to 9’ instead of the regular setback of 25’ so he could add a den to the rear of his home. Chairman Moore questioned and Mr. Robinson concurred that there is an enclosed porch on the rear of the home. Chairman Moore presented a diagram of the home he obtained from Pulaski County records, which is different MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: March 9, 2015 6:30 p.m. – 6:44 p.m. from the original drawing. He pointed out that the diagram from Pulaski County shows an 18’ X 8’ enclosed porch. He then confirmed with the petitioner that he proposing to construct an 18’ X 27’ addition for a den. City Engineer Whisker stated that the structure itself has just been built out of the flood plain, adding that any further construction will have to be built up with fill and then obtain a letter of map revision from the government so they would not have to pay flood insurance. He stated that Mr. Robinson is aware of the things that he will have to do if the variance is granted. Chairman Moore clarified that the patio is a screened enclosed porch. Mr. Robinson added that the roof is tied into the porch. He then clarified with Mr. Robinson that the enclosed porch has 4’ permanent walls. In response to a question from Chairman Moore, City Engineer Whisker explained that the setback is 25’ and the proposed construction would end 9’ from the rear of the property in a direct line. He clarified that the petitioner is requesting a 16’ variance. He then answered Chairman Moore that the easement is 7.5’ on the rear of the property. He calculated that currently the primary structure is 43’ from the back line and the additional 27’ would leave them 16’ from the back line. He then corrected that the request would be to intrude 9’ into the 25’ rear yard setback. With no one to speak in opposition, Chairman Moore closed the public hearing at approximately 6:40 p.m. Chairman Moore questioned if Mr. Robinson would be amenable to changing the proposed 27’ out from the primary structure to the 18’ he has proposed for the width of the structure, which would cut down the amount of encroachment. He then noted that reorientation of the proposed construction would cut down on the amount of fill needed to bring the structure out of the flood plain. Mr. Robison conferred with City Engineer Whisker regarding the ramifications of changing the orientation of the addition and the location of the original patio. Commissioner Healey noted that when he visited the property he noted that there is approximately 18’ from the side of the house to where the enclosed structure begins. He pointed out that the drawing provided is somewhat inaccurate. Commissioner Healey moved, seconded by Alderman Howard to approve the rear yard setback variance of 9’ at 507 Jessica Court as requested. MOTION CARRIED with Chair voting AYE.
