APPROVAL AND/OR CORRECTION OF MINUTES: Regular Scheduled Meeting October 13, 2008 1-4 3. VARIANCE REQUEST(S): Front yard setback variance 22 Red Oak Cove Petitioner: Bert Vasquez 5-6 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: November 10, 2008 6:30 p.m. – 6:38 p.m. ATTENDANCE: Commissioners: Bart Gray, Jr., Art Brannen, Chairman Chad Young, and City Planner Chip McCulley were present _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Young declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Brannen moved, seconded by Commissioner Gray to approve the minutes of the regularly scheduled Board of Adjustment meeting of October 13, 2008. MOTION CARRIED with Chairman Young voting AYE. VARIANCE(S): Front yard setback variance at 22 Red Oak Cove Chairman Young opened the public hearing at approximately 6:30 p.m. City Planner McCulley explained that in the process of obtaining bids to perform the construction, he met with Mrs. Vasquez’s builder regarding the need for a front yard setback variance. He related that he examined the site, noting that a 10’ variance from the 35’ setback would be necessary to construct the proposed carport. He stated that if the variance is approved the house would still meet with the new 25’ front yard setback standard. He related that prior to viewing the site he had reservations regarding a 10’ front yard variance because of the proper lining up of houses along the front. He then explained that this house is in a unique position on Red Oak Cove, saying that it is on a short cul-de-sac where the houses are not straight in a row. He went on to say after measuring the variance he felt comfortable with the variance request. In response to a question posed by Chairman Young, Mrs. Vasquez stated that it would be a wood frame structure that would tie into the existing roofline. City Planner McCulley noted that the bay window in the front has a roofline problem, which would be corrected with the addition of the carport. Mrs. Vasquez explained that the bay window is lined up with the roofline so rainwater comes in the window. She then answered that the sides of the structure would be open with an asphalt shingle roof to match the house. Discussion ensued regarding the bushes to the side of the proposed carport and Mrs. Vasquez noted that most likely some of the bushes would have to be removed. She then answered Chairman Young that the extended carport is for her personal vehicle parking. She reiterated the benefit of being able to correct the situation with the bay window. City Planner McCulley noted that Mrs. Vasquez had submitted a permission list from all her neighbors on Red Oak Cove. Commissioner Gray stated that he felt the request is reasonable since the cul-de-sac is short and none of the present homes line up. He stated that if this house were on a straight street it would be more difficult to give consideration for a variance when the neighborhood had been developed along the setback. He stated that he would not be opposed. BOARD OF ADJUSTMENT REGULAR MEETING November 10, 2008 Commissioner Gray moved, seconded by Commissioner Brannen to approve the 10’ front yard variance as requested. MOTION CARRIED. Chairman Young closed the public hearing at approximately 6:38 p.m. ADJOURNMENT: Without objection, Chairman Young adjourned the meeting at approximately 6:38 p.m. MOTION CARRIED.
