MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING
DATE AND TIME: February 13, 2006 6:35 p.m. – 6:58 p.m.

City Clerk Susan Davitt recorded those listed above in attendance and Chairman Traylor declared a quorum.
APPROVAL AND/OR CORRECTION OF MINUTES:
Commissioner Gray moved, seconded by Commissioner Perry to approve the minutes of the Regularly Scheduled Board of Adjustment meeting of November 14, 2005. MOTION CARRIED.
VARIANCE(S): a. Vehicle Variance at 808 McHenry
Chairman Traylor opened the public hearing at approximately 6:35 p.m.
Mr. Gary Cox of 808 McHenry stated that he would like to keep the vehicle without building a garage.
In response to a question posed by Commissioner Perry, Mr. Cox estimated that restoration of the vehicle is approximately 80% finished. He explained that during a radio theft a lot
of the wiring had been ripped out of the vehicle. He presented the Board with photographs of the vehicle during various stages of restoration. He then showed the Board various parts
still in their store packages, which he plans to use to continue repairing the vehicle. He then answered that he has owned the vehicle for 15 years, noting that it had sat beside the
carport with some amount of debris for approximately 4 to 5 years. He stated that following the birth of his son; funds were not available to continue the project.
In response to a question posed by Chairman Traylor, Mr. Cox answered that the theft on the vehicle occurred Halloween night approximately 5 years ago, adding that until that time the
truck had been operable.
Commissioner Keaton questioned a possible time frame for rewiring the vehicle, and Mr. Cox stated that he was not sure how long it would take because of his weekly working schedule and
his son’s ball schedule on the weekends. He reiterated that the vehicle has been moved under the carport and that he would be willing to buy a cover if the Board directed him to do
so. He stated that he would like a time extension to the summer; noting Daylight Savings Time as a benefit to be able to work on the vehicle.
In response to a question posed by City Engineer Whisker, Mr. Cox replied that he has not worked on the vehicle since being tagged by the City.
City Engineer Whisker then answered Commissioner Gray that generally the process of tagging a vehicle begins as a complaint from a neighbor. He noted that in this case the Code Enforcement
Officers were responding to complaints regarding several vehicles in the Subdivision. He then explained that an inoperable vehicle must be removed from the property after seven (7)
days or enclosed in a garage. He noted that this type of complaint is more common in areas that have carports instead of garages. He then explained that in Mr. Cox’s case his front

underneath the carport, which would require changing the entrance into his home to enclose the carport and make it into a garage. He then explained that all other tagged vehicles have
been moved, adding that Mr. Cox was going to apply for last month’s Board of Adjustment but there was some confusion about those plans and then Mr. Cox was given another seven (7) days
to either move the vehicle or apply to the Board of Adjustment. He then answered that if the vehicle is not moved in the time frame given, the City will have the vehicle towed. He
related that following a vehicle repair, the owner generally calls the City to alert them that the vehicle has been repaired and is operable.
Discussion ensued regarding a reasonable time to allow Mr. Cox to bring the vehicle to an operable condition.
Commissioner Gray moved, seconded by Commissioner Perry to grant a vehicle variance until May 16th at 808 McHenry to bring the vehicle into compliance with City Codes. MOTION CARRIED.
Chairman Traylor closed the public hearing at approximately 6:51 p.m.
Addition to the Agenda:
City Engineer Whisker stated that he has a request from Linda Batiste, who appeared before the Board of Adjustment recently regarding a setback variance for an addition to her home.
He explained that the second request is to expand the size of the addition from 20’ X 18’ to 24’ X 22’. He then explained that Mrs. Batiste has signed a contract with her contractor
to have the work performed during a certain period of time but is not able to begin construction until the variance issued is cleared up. He stated that Mrs. Batiste is requesting a
special hearing because of the cost factor associated with the contractor charging without being able to begin the work.
Discussion ensued regarding availability for the Board to meet following advertising considerations.
Commissioner Gray moved, seconded by Commissioner Keaton to set a special hearing Monday, February 27th at 6:30 p.m. regarding a setback variance at #19 Georgeann. MOTION CARRIED.
ADJOURNMENT:
Without objection, Chairman Traylor adjourned the meeting at approximately 6:58 p.m. MOTION CARRIED.
