VARIANCE REQUEST(S): Building Setback Variance Lot 1 of the Rebsamen Medical Subdivision on Marshall Road/John Harden Drive Petitioner: Mike Hanner Representative: Bond Engineering ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: April 24, 2006 6:00 p.m. – 6:13 p.m. ATTENDANCE: Commissioners: Glen Keaton, Bart Gray, Jr., Mark Perry, and Martha Boyd Chairman Traylor, and City Engineer Whisker _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Traylor declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: VARIANCE(S): Building line Setback Variance at Lot 1 Rebsamen Medical Subdivision Chairman Traylor opened the public hearing at approximately 6:00 p.m. Mr. Tommy Bond related that a C-3 and C-4 zoning line is the lot line. He explained that Mr. Haskins purchased lot 1 of Rebsamen Medical Subdivision a few years ago and was not aware of the setback or the bill of assurance. He stated that because the lot is a C-3 it requires a 50’ setback and the adjoining property has a 25’ setback. He related that the request is for a 25’ setback on lot 1, adding that the petitioner is trying to purchase Lot 2 and if successful would return with a similar request for that lot. He then related that the Hospital Board would approve an amended bill of assurance for lot 1, adding that a proposal to sell lot 2 is being negotiated with the Hospital Board. He also noted that the only other issue in negotiation is the movement of the Hospital billboard. Commissioner Perry arrived at approximately 6:03 p.m. In response to a request by Commissioner Keaton, Mr. Bond offered a copy of the Rebsamen Medical Subdivision for the Board to review. City Engineer Whisker clarified that the Subdivision consists of six lots along John Harden to Braden, noting that lot 3 or 4 is the Kidney Dialysis Clinic. Commissioner Gray noted that the plat offered for review includes Lot 1 that is being considered for a variance. City Engineer Whisker demonstrated on the plat the location of the 50’ and 25’ build lines. Mr. Bond explained that the different build lines would interfere with the proposed development plans. In response to a question posed by Commissioner Keaton, Mr. Bond related that the buyer is proposing to move the Hospital billboard to the corner of Lot 1. City Engineer Whisker noted that the property is being proposed for a shopping center, which is a C-2 zone that requires a 25’ setback. Commissioner Gray noted that a variance from 50’ to 25’ would correspond with the adjoining property. BOARD OF ADJUSTMENT REGULAR MEETING April 24, 2006 Commissioner Gray moved, seconded by Commissioner Boyd to grant a 25’ setback variance for Lot 1 of the Rebsamen Medical Subdivision. MOTION CARRIED. Chairman Traylor closed the public hearing at approximately 6:12 p.m. ADJOURNMENT: Without objection, Chairman Traylor adjourned the meeting at approximately 6:13 p.m. MOTION CARRIED.
