VARIANCE REQUEST(S): Building line Setback Variance 1000 West Main Petitioner: Arkansas Carwash (photograph included in packet) 5-6 ADJOURNMENT MINUTES: BOARD OF ADJUSTMENT REGULAR MEETING DATE AND TIME: May 9, 2005 6:30 p.m. – 6:45 p.m. ATTENDANCE: Commissioners: Mike Traylor, Bart Gray, Jr. and Mark Perry Chairman Keaton, and City Engineer Whisker _________________________________________________________________ City Clerk Susan Davitt recorded those listed above in attendance and Chairman Keaton declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Perry moved, seconded by Commissioner Traylor to approve the minutes of the Regularly Scheduled Board of Adjustment meeting of April 11, 2005. MOTION CARRIED. VARIANCE(S): Building line Setback Variance at 1000 West Main Chairman Keaton opened the public hearing at approximately 6:31 p.m. Mr. Charles Thomas stated that he is the representative for Arkansas Carwash Systems. He related a long-term interest in the site for a carwash, adding that the only hindrance is the amount of room for locating a carwash with vacuums. He explained that the setback is too close to the building in order to have room for the vacuums. He stated that the variance request is to move the vacuums closer to the road, adding that there would still be approximately 15’ of green area between the vacuums and the road. City Engineer Whisker conjectured that there would be approximately 25’ from the centerline of the road. He answered that while the vacuums are not a large structure it would require a variance. Chairman Keaton noted that the proposed development would be located directly across the street from Double R Florist. Chris and Bill Stroud announced their attendance as representing the interest of Double R Florist. Discussion ensued regarding the current building being located within the 25’ setback. Regarding the location of the current building, Mr. Thomas was not able to decipher if the vacuums would be closer to the street than the current building. Mr. Thomas then answered that there would be two accesses one from Main Street and one from Jeff Davis Avenue. Mr. Bill Stroud related drainage issues regarding heavy rains and flooding of the building where Double R Florist is located. Consideration for rebuilding the ditch was discussed. City Engineer Whisker clarified that the water flow comes down Main Street, adding that the City has helped by digging a ditch upstream and noting an inlet at the corner. He stated that he has spoken with the developer regarding drainage issues that would have to be contained to his property, pointing out that an inlet is available on the property. He related that the water moves south directly under Hastings, explaining that there is BOARD OF ADJUSTMENT REGULAR MEETING May 9, 2005 a 36” pipe underneath Hastings, which is where all the water flows. Commissioner Gray noted that there is access to the drain regarding the property being presented for development. It was noted that it would be a matter of making sure that the water on the development collects and drains into the inlet. Mr. Thomas then answered that he would be willing to put sidewalks along the curb if so required by the City. He also answered that he is not sure how much noise the vacuums would make, adding that there have not been any complaints or problems. He then related that his firm recommends strongly that an attendant be made available on site. Discussion ensued regarding the clean, well-maintained appearance of Splash Carwash sites. Mr. Thomas stated that a great deal of effort is put into the design of the carwash to make it safe for women. He noted the open design and placement of the vacuums to the front of the development. In response to a question from Mrs. Stroud, Mr. Thomas stated that he is not sure what buildings would be removed, noting that the owner of the property is responsible for removing all the buildings located on the two lots being purchased. Mrs. Stroud went on to relate that her concern as a retail merchant would be aesthetics, drainage, and traffic congestion. She added that she is not so worried about the traffic congestion, now that Mr. Thomas has explained that the vacuums would not have vehicle drive-through access onto the street. Discussion ensued regarding the enhanced aesthetics for Splash carwash sites and Mr. Mike Burk related that 60% of the customer base for automatic carwashes is female, which would be complimentary for the florist shop across the street. Chairman Keaton closed the public hearing at approximately 6:45 p.m. Commissioner Perry moved, seconded by Commissioner Gray to approve a building line setback variance for installation of vacuums at 1000 West Main. MOTION CARRIED. BOARD OF ADJUSTMENT REGULAR MEETING May 9, 2005 ADJOURNMENT: Commissioner Perry moved, seconded by Commissioner Traylor to adjourn the meeting at approximately 6:45 p.m. MOTION CARRIED.
