94 AUG 24MINUTES: BOARD OF ADJUSTMENT DATE AND TIME: August 24, 1994 4:06 p.m. 4:28 p.m. ATTENDANCE: Commissioners: Chairman Art Brannen, Larry Baldwin and B. J. Boroughs Code Enforcement Officer Wayne Cox and Asst. Code Enforcement Officer Vern Howell represented the City of Jacksonville. PETITIONER: Mr. Jim Green Variance requested: Square Footage for an accessory building (Violation of Chapter 18.86.020) __________________________________________________________________ Deputy City Clerk Susan L. Goings recorded those listed above in attendance and Chairman Brannen declared a quorum. APPROVAL AND/OR CORRECTION OF MINUTES: Commissioner Boroughs moved, seconded by Commissioner Baldwin that the minutes of the Board of Adjustment Meeting of February 9, 1994 be APPROVED. MOTION CARRIED. Chairman Brannen voiced the request for a variance with regard to construction of an accessory building to be located at 1613 Foxwood Drive by Mr. Jim Green, which is in violation of Chapter 18.86.020. Chairman Brannen read the violation as cited in the Jacksonville Municipal Code Book as follows: 18.86.020 Square Foot Limitations. An accessory building may occupy no more than thirty percent (30%) of the existing rear yard not to exceed six hundred fifty (650) square feet and shall not be built closer than five (5) feet to the owner's property line or in compliance with a subdivision's Bill of Assurance, whichever is greater. It was noted that the property is not governed by a Bill of Assurance. At approximately 4:09 p.m. Mr. Brannen opened the Public Hearing. It was noted by Chairman Brannen that all setbacks are within code. Mr. Green displayed a drawing of the building, explaining that the end of the building will face south to the street and the front of the building will face east to the entering driveway. He related that the building will be constructed of both brick and siding of normal house type construction. He related that the intended use of the building will be a garage to store cars as well as a boat and a mowing tractor. There was concern voiced by citizens that the garage may be used to house heavy equipment. BOARD OF ADJUSTMENT August 24, 1994 Mr. Green related that his business did not require he own such equipment and that in fact he did not own equipment of that nature. In response to a question posed by Mr. Baldwin, Mr. Green related that it is not his desire to rezone the property located directly north of the proposed residence. He further related that the property is too low to develop adding that it is six to seven feet below the flood zone. It was noted by Mr. Boroughs that there is fifty two feet from the property line to the proposed garage on the west side which is the closest point of connection. Citizens at the meeting voiced concerns over the possibility of Mr. Green operating a business from his home. Mr. Green assured the members of the board and the citizens that was not his intent, adding that the property is not zoned for that type of use. He related that his business office is located at Stonewall Square. There was concern voiced over the height of the garage doors. Mr. Green related that his mowing tractor has a roll bar which will need a tall door for clearance. At approximately 4:26 p.m. Chairman Brannen declared the Public Hearing closed. Mr. Baldwin moved, seconded by Mr. Boroughs to grant the variance as requested with regard to maximum square footage, allowing for an accessory building of 1,620 square feet to be constructed at 1613 Foxwood Drive. ROLL CALL: Commissioner: Brannen, Baldwin, Boroughs vote AYE. Motion received three (3) AYE and (0) NAY. MOTION CARRIED.
