20 APR 02CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING APRIL 2, 2020 6:00 P.M. – 6:18 P.M. REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on April 2, 2020 at the regular meeting place of the City Council. Council Member Bolden delivered the invocation and Mayor Johnson led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: City Council Members: Bolden, Sipes, Sansing, Ray, Traylor, and Collins answered ROLL CALL. Mayor Johnson also answered ROLL CALL declaring a quorum. PRESENT SIX (6) ABSENT (3) ONE SEAT VACANT. Others present for the meeting were: City Attorney Stephanie Friedman. PRESENTATION OF MINUTES: Mayor Johnson presented the minutes of the regular City Council meeting of March 5, 2020 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Council Member Bolden moved, seconded by Council Member Traylor that the minutes of the special scheduled City Council meeting of 31 January 2020 and the regular scheduled City Council meeting of 20 February 2020 be APPROVED. MOTION CARRIED. CONSENT AGENDA: REGULAR MONTHLY REPORT/POLICE DEPARTMENT Council Member Ray moved, seconded by Council Member Traylor to approve the Regular Monthly Report for February 202020 regarding annual crime statistical comparisons. REGULAR MONTHLY REPORT/FIRE DEPARTMENT Council Member Ray moved, seconded by Council Member Traylor to approve the regular monthly report for February 2020 from the Jacksonville Fire Department, reflecting a fire loss of $114,000.00 and a savings total of $35,000.00. ROLL CALL: Council Member: Bolden, Sipes, Sansing, Ray, Traylor, and Collins voted AYE. MOTION CARRIED. WATER DEPARTMENT: WASTEWATER DEPARTMENTS: FIRE DEPARTMENT: ORDINANCE 1630 (#04-2020) AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF SPECIFIC COMPUTER SOFTWARE FOR THE FIRE DEPARTMENT; FOR APPROPRIATE TRAINING AND ACCESS FOR DEPARTMENT REPRESENTATIVES; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. Council Member Bolden moved, seconded by Council Member Sansing to place Ordinance 1630 on FIRST READING. ROLL CALL: Council Member Bolden, Sipes, Sansing, Ray, Traylor, and Collins voted AYE. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Ordinance 1630. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING APRIL 2, 2020 6:00 P.M. – 6:18 P.M. Council Member Bolden moved, seconded by Council Member Ray to approve Ordinance 1630 on FIRST READING and SUSPEND THE RULES to place Ordinance 1630 on SECOND READING. In response to a question from Council Member Traylor, City Attorney Friedman answered that this is the same vendor, she explained that essentially it is two software companies providing services and one company bought out the other. She added that it reduced the City’s cost to one company but increased the cost of the company taking those services over. She recalled that initially the City Council approved a $27,000.00 in 2014 but now it has gone up since they are taking on more services, so that is the only difference. Mayor Johnson then answered Council Member Sipes assuring him that the money is in the budget. ROLL CALL: Council Member Bolden, Sipes, Sansing, Ray, Traylor, and Collins voted AYE. MOTION CARRIED. Council Member Ray moved, seconded by Council Member Bolden to further SUSPEND THE RULES and place Ordinance 1630 on THIRD AND FINAL READING. ROLL CALL: Council Member Bolden, Sipes, Sansing, Ray, Traylor, and Collins voted AYE. MOTION CARRIED. Council Member Ray moved, seconded by Council Member Bolden to APPROVE AND ADOPT Ordinance 1630. ORDINANCE 1631 (#05-2020) AN ORDINANCE AMENDING JACKSONVILLE CITY ORDINANCE 1628, CHANGING THE DATE FOR THE SPECIAL ELECTION OF CITY COUNCIL MEMBER OF WARD ONE, POSITION ONE FOR THE CITY OF JACKSONVILLE, ARKANSAS; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. Council Member Bolden moved, seconded by Council Member Traylor to place Ordinance 1631 on FIRST READING. ROLL CALL: Council Member Bolden, Sipes, Sansing, Ray, Traylor, and Collins voted AYE. ROLL CALL: Council Member Bolden, Sipes, Sansing, Ray, Traylor, and Collins voted AYE. MOTION CARRIED. ORDINANCE 1631 (#05-2020) APPROVED AND ADOPTED THIS 2nd DAY OF APRIL, 2020. b. RESOLUTION 791 (#2-2020) A RESOLUTION ESTABLISHING MEETING PROTOCOL FOR THE CITY OF JACKSONVILLE DURING TIME OF NATIONAL OR STATEWIDE EMERGENCY Mayor Johnson stated that this Resolution would allow the City Council to change how City Council meetings are conducted, allowing for them to be performed electronically. Council Member Ray moved, seconded by Council Member Sipes to read Resolution 791. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Resolution 791. Council Member Ray moved, seconded by Council Member Sipes to adopt Resolution 791 (#02-2020) in its entirety. In response to a question from Council Member Traylor, City Attorney Friedman stated that this is allowable, adding that most of the central Arkansas cities have already done this. She stated that it is to provide a little CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING APRIL 2, 2020 6:00 P.M. – 6:18 P.M. more leniency, noting that it is only for a National or Statewide emergency. Mayor Johnson clarified that a Statewide emergency would be called by the Arkansas Governor. He offered a brief background, explaining that the Governor was having a special session so he called the Governor to include the ability for cities to hold meetings electronically. He then explained that the Governor’s Office told him to get the Fort Smith Ordinance and pass a similar one, which will protect the City from FOIA laws. He stated that the next City Council meeting will be live streamed and the City Council members will call in. Council Member Traylor pointed out that this is a resolution not an ordinance. Mayor Johnson clarified that it was a resolution. City Attorney Friedman stated that the Resolution is a combination of Fort Smith, Little Rock, and Glenwood. In response to a question from Council Member Collins, Mayor Johnson explained that the City has purchased a camera that will live stream to the public on the City’s website and we will have someone to do the sign language and we will have closed caption. We are working on a device so the City Council can call in their vote. IT Director Scott Rothlisberger stated that it is basically a conference call, saying that each City Council member will call into a conference and the microphone to the speaker phone. He stated that each City Council member will have to identify who you are and what your vote is. He stated that it would be live stream to the website with closed caption if we cannot get someone to sign. Mayor Johnson stated that he feels he will be able to get an interpreter. Council Member Collins noted that there are some online services that will do that at no costs. Mayor Johnson stated that the City will not be out a great cost to get it live streamed and if this goes on indefinitely then we will probably be where we can do a video and other means. He stated that for now this will serve our purpose. Council Member Collins moved, seconded by Council Member Traylor to adopt Resolution 791 (#02-2020) in its entirety. MOTION CARRIED. c. CDBG Consolidated Annual Performance and Evaluation Report (CAPER) Council Member Bolden moved, seconded by Council Member Ray to approve the Consolidated Annual Performance and Evaluation Report as submitted. MOTION CARRIED. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING APRIL 2, 2020 6:00 P.M. – 6:18 P.M. APPOINTMENTS: PLANNING COMMISSION Appointment of Greg Bollen for a term to expire 01/01/2023 Council Member Bolden moved, seconded by Council Member Sansing to approve the appointment of Greg Bollen to the Planning Commission for a term to expire 01/01/2023. Council Member ANNOUNCEMENTS: Council Member Ray reminded everyone to participate in the Census that was recently mailed to everyone. Mayor Johnson stated that public announcements are being made to help make the public aware. Council Member Collins stated that he would like to have a resolution to recognize our basketball team, Mayor Johnson concurred. Council Member Bolden commended the first responders, expressing his desire to see them remain safe. Council Member Ray asked for a resolution in support of continuing a tax levy for the Highway Department.
