REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in special session on November 26, 2019 at the regular meeting place of the City Council. Council Member Ray delivered the invocation and Mayor Johnson led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: City Council Member: Elliott, Bolden, Sansing, Mashburn, Traylor, Twitty, Smith, and Collins answered ROLL CALL. Mayor Johnson also answered ROLL CALL declaring a quorum. PRESENT NINE (9) ABSENT (1). Council Member Mashburn and Ray were absent. Others present for the meeting were: City Attorney Stephanie Friedman, Public Works Director Jim Oakley, Interim Police Chief McCollough, CDBG Director Theresa Watson, Human Resource Director Charlette Nelson, Finance Director Cheryl Erkel, Parks and Recreation Director Kevin House, Director of Downtown Planning and Development Bob Price, Patrick Thomas, Brian Blevins, interested citizens, and members of the press. PRESENTATION OF MINUTES: APPROVAL AND/OR CORRECTION OF MINUTES: CONSENT AGENDA: WASTEWATER DEPARTMENTS: WATER DEPARTMENT: FIRE DEPARTMENT: POLICE DEPARTMENT: STREET DEPARTMENT: SANITATION DEPARTMENT: PARKS & RECREATION: PLANNING COMMISSION: ORDINANCE 1624 (#31-2019) AN ORDINANCE AMENDING AND MODIFYING JACKSONVILLE MUNICIPAL CODE § 18.52.020 ALLOWING MICROBREWERIES AS A PERMITTED USE IN C-4 ZONES WITHIN THE CITY OF JACKSONVILLE, ARKANSAS; AND, FOR OTHER PURPOSES. Council Member Bolen moved, seconded by Council Member Elliott to place Ordinance 1624 on FIRST READING. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Traylor, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Ordinance 1624. Mayor Johnson explained that the microbrewery is wanting to relocated to the shopping center where Fuzz’s Tacos use to be and it is zoned C-4 so we are proposing to add microbreweries to C-4 so we do not have to keep approving this various places. He clarified that this would make it permanent for C-4. He related that he has been in contact with the ABC Board about microbreweries and found out that there is no specified distance regarding how far they have to be located from a school. He stated that microbreweries are under a whole different set of laws than anybody else. He stated that this is allow Blade and Barrel, who have already signed their lease, and are CITY OF JACKSONVILLE BUDGET CITY COUNCIL MEETING NOVEMBER 26, 2019 6:00 P.M. – 8:05 P.M. wanting to start. He stated that they have a plan for a smaller operation than they had expected originally. He stated that they have their architect design and have met with Sewer and Water Departments. Mayor Johnson then answered Council Member Traylor that they are leasing a space in the shopping center where Fuzzy’s was located. Council Member Twitty questioned if this would require notifying the public, saying that she is aware of the notice when the brewery first started their process, especially since the location has changed from the original plan. Mayor Johnson stated that the ABC Board has rules that it has to be posted for 4 weeks. City Attorney Friedman agreed, saying that it is 4 consecutive weeks. Mayor Johnson continued saying that if anyone has a problem they can contact the ABC Board. City Attorney Friedman stated that this Ordinance is just to add microbreweries as a permitted use, it is not for that specific location. Council Member Traylor clarified that it is for C-4 zones. City Attorney Friedman stated that before they open they still have to publish it 4 consecutive weeks in the paper. Mayor Johnson then answered Council Member Twitty that it would be in our local paper. City Attorney Friedman confirmed that it has to be in a local paper. Mayor Johnson stated that he is not sure if it has to be in both papers, but it will at least be in the Leader. Mayor Johnson then assured Council Member Twitty that if the City received any calls about the microbrewery they would be directed to call the ABC Board. He then added that he would be willing to talk to anyone calling and tell them what information he has. He then related that the microbrewery is doing all electric instead of natural gas, adding that it will be very safe. He stated that Blade and Barrel are very excited and ready to be here. He concluded saying that this Ordinance is modifying C-4 zone only. He then answered Council Member Traylor that they are planning to serve food. He stated that they will start with food trucks, but will have other stuff, and will rotate food trucks. He stated that this is what they are doing, but what we are doing is setting up a zone so others can come in, which might be a full service restaurant with a microbrewery. Council Member Traylor moved, seconded by Council Member Bolden to approve Ordinance 1624 on FIRST READING and SUSPEND THE RULES and place Ordinance 1624 on SECOND READING. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Traylor, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. Council Member Sansing moved, seconded by Council Member Sipes to further SUSPEND THE RULES and place Ordinance 1624 on THIRD AND FINAL READING. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Traylor, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. Council Member Sansing moved, seconded by Council Member Bolden to APPROVE AND ADOPT Ordinance 1624. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Traylor, Twitty, Smith, and Collins voted AYE. MOTION CARRIED. ORDINANCE 1624 (#31-2019) APPROVED AND ADOPTED THIS 26th DAY OF NOVEMBER, 2019. GENERAL: Proposed 2020 Budget Finance Director Cheryl Erkel answered Council Member Traylor that 2019 revenues are only reflecting activity through August. She then answered Council Member Smith that other expenses under the Shooting Range are the costs of depreciation and costs of goods. She related that the depreciation reduces the value amount on our assets but it does not hit the cash account. She stated that it is just a booking entry. She then added that the costs of goods sold, whenever we purchase items, we put it in inventory and as we sell it, we take it out of inventory and we report it as costs of goods sold. Mayor Johnson noted that $100,000 was budgeted to help the Shooting Range in 2019, asking if we have used any of it this year. Finance Director Cheryl Erkel stated that we have not made any operating transfers into the Shooting Range. She then answered Council Member Bolden that the Shooting Range is taking care of itself. She then answered Council Member Sansing that when the Shooting Range shows a loss it is due to depreciation and is not an actual cash loss. She then agreed with Council Member Sansing that not taking the depreciation into account the Shooting Range has made a profit.
