19 DEC 05CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING DECEMBER 5, 2019 6:00 P.M. – 6:19 P.M. REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in regular session on December 5, 2019 at the regular meeting place of the City Council. Council Member Ray delivered the invocation and Mayor Johnson led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: City Council Members: Elliott, Bolden, Sipes, Sansing, Ray, Mashburn, Twitty, and Collins answered ROLL CALL. Mayor Johnson also answered ROLL CALL declaring a quorum. PRESENT EIGHT (8) ABSENT (2). Others present for the meeting were: City Attorney Stephanie Friedman, Public Works Director Jim Oakley, IT Director Scott Roethlisberger, CDBG Director Theresa Watson, Fire Chief Alan Laughy, Interim Police Chief Joseph McCollough, Parks and Recreation Director Kevin House, Parks & Recreation Marketing & Public Relations Manager Marlo Jackson, Human Resource Director Charlette Nelson, Finance Director Cheryl Erkel, Addie Gibson, Director of Downtown Planning and Development Bob Price, Dejuana Sipes, Patrick Thomas, Johnny Simpson, Amanda Erickson, interested citizens, and members of the press. PRESENTATION OF MINUTES: Mayor Johnson presented the minutes of the regular City Council meeting of November 21, 2019 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Council Member Bolden moved, seconded by Council Member Mashburn that the minutes of the regularly scheduled City Council meeting of 7 November 2019 be APPROVED. MOTION CARRIED. CONSENT AGENDA: REGULAR MONTHLY REPORT/ENGINEERING DEPARTMENT Council Member Elliott moved, seconded by Council Member Bolden to approve the regular monthly report for November 2019. PLANNING COMMISSION: COMMITTEE(S): a. Used Car Lot Committee Council Member Mashburn Council Member Mashburn stated that the Committee will meet one more time before presenting an ordinance to the City Council. b. Ordinance 1584 (#06-2018) Out of State property owners maintaining a local registered agent Council Member Collins Council Member Collins stated that he did not receive any feedback from the other members on the Committee, stating that he would have a committee report at the next regularly scheduled City Council meeting after speaking with Council Member Traylor. c. Citywide Step & Grade Pay-Scale Council Member Mashburn Council Member Mashburn related that they have had their first meeting and will have another meeting at a later time. GENERAL: a. ORDINANCE 1625 (#32-2019) AN ORDINANCE ADOPTING A FISCAL BUDGET FOR 2020; MAKING APPROPRIATIONS AND AUTHORIZING EXPENDITURES FOR OPERATION OF VARIOUS DEPARTMENTS OF CITY GOVERNMENT; FOR THE PURCHASE OF MATERIALS, SUPPLIES, EQUIPMENT, AND SERVICES COVERING GENERAL FUND OPERATIONS, STREET FUND, EMERGENCY MEDICAL SERVICES FUND, SHOOTING RANGE FUND, AND SANITATION FUND; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES. Council Member Ray moved, seconded by Council Member Bolden to place Ordinance 1625 on FIRST READING. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Ray, Mashburn, Twitty, and Collins voted AYE. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Ordinance 1625. In response to a question from Council Member Mashburn, Parks and Recreation Director Kevin House stated that they are looking at ways to limit the losses with the Shooting Range. He offered that they are looking at cutting hours through the winter and lessening the staff through the week when not needed. He assured Council Member Mashburn that they would do everything they can, noting that currently for the year the losses are at approximately $66,000.00. He then answered Council Member Sipes that they did raise the fees. In response to a question from Council Member Twitty, Director House informed the City Council that next year there are 52 tournaments planned for 2020 which is an increase from 48 in 2019. He then assured Council Member Mashburn that they are being proactive in attracting more tournaments. He stated that because the weekends are booked they are focusing on booking corporate events during the week. He then responded to Council Member Sipes, explaining that the Jacksonville Facilities Board is going to fund the construction of the screen. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Ray, Mashburn, Twitty, and Collins voted AYE. MOTION CARRIED. Council Member Ray moved, seconded by Council Member Sansing to further SUSPEND THE RULES and place Ordinance 1625 on THIRD AND FINAL READING. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Ray, Mashburn, Twitty, and Collins voted AYE. MOTION CARRIED. Council Member Sansing moved, seconded by Council Member Ray to APPROVE AND ADOPT Ordinance 1625. Council Member Ray moved, seconded by Council Member Elliott that the EMERGENCY CLAUSE be approved and adopted. ORDINANCE 1625 (#32-2019) APPROVED AND ADOPTED THIS 5th DAY OF DECEMBER, 2019. c. ORDINANCE 1626 (#33-2019) AN ORDINANCE AMENDING JMC §9.12.010 TO PROHIBIT THE USE OF, AND DISCHARGE OF METAL-TIPPED ARROWS WITHIN THE CITY OF JACKSONVILLE; AND, FOR OTHER PURPOSES. Council Member Bolden moved, seconded by Council Member Ray to place Ordinance 1626 on FIRST READING. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Ray, Mashburn, Twitty, and Collins voted AYE. MOTION CARRIED. Whereupon City Attorney Friedman read the heading of Ordinance 1626. Council Member Bolden explained that there have been incidents in the Stonewall Subdivision of residents shooting metal-tipped arrows in their backyards which have gone through fences and even into other residents’ houses. He noted that this Ordinance would be added to the provisions regarding firearms in the City of Jacksonville. Council Member Sansing stated that there is a 3-D archery range at the Shooting Range for practice. Council Member Collins stated that “projectiles” would be better phrasing than discharge of “firearms”. City Attorney Friedman stated that she would make that change. Council Member Ray moved, seconded by Council Member Bolden to approve Ordinance 1626 on FIRST READING and SUSPEND THE RULES to place Ordinance 1626 on SECOND READING. ROLL CALL: Council Member Elliott, Bolden, Sipes, Sansing, Ray, Mashburn, Twitty, and Collins voted AYE. MOTION CARRIED. Council Member Bolden moved, seconded by Council Member Sansing to APPROVE AND ADOPT Ordinance 1626. APPOINTMENTS: PLANNING COMMISSION Council Member Ray moved, seconded by Council Member Elliott to approve the appointment of William Montgomery for a term to expire 01/01/2023. MOTION CARRIED. UNFINISHED BUSINESS: NEW BUSINESS: ANNOUNCEMENTS: Public Comments: Amanda Erickson declined to speak at this time. Council Member Sansing recognized the Historical District being able to have their first meeting in their new building, he stated that Council Member Mashburn has been working very hard on that. Council Member Bolden announced that he and his wife Cynthia have had their first grandchild born last night, named Bennett James Bolden weighing 7 lbs. 6 oz. and 17 inches long. Mayor Johnson reminded everyone that the Christmas Parade is Saturday, December 7th. He then announced that it would be a full day of events starting at 10:00 a.m. He then announced that Sunday, December 15th from 3:00 p.m. to 5:00 p.m. there will be Christmas photos with Santa for pets at the Unique Connection Center. He noted that it will be a fundraiser for the Jacksonville Arts Theater and Live Academy. He announced that City employment service awards will be held at 10:30 a.m., Thursday, December 12th at City Hall. He then noted that he would be having knee surgery on December 17th, adding that he would not be attending the next City Council meeting. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING DECEMBER 5, 2019 6:00 P.M. – 6:19 P.M. Council Member Elliott announced that he would resign from his position as Council Member of Ward 1, Position 1 effective December 30, 2019. He stated that it has been a tough decision but he feels it is best for his family and his retirement. He added that he loves the City and will continue to be involved in the City. Mayor Johnson stated that there are rules and procedures to replace a Council Member, asking City Attorney Friedman to email those rules. He then stated that the City Council can either vote a replacement or the City can hold a special election. He then asked for any recommendations from Ward 1. Council Member Elliott then responded to a question, answering that he has served on the City Council for the past 23 years. The City Council collectively thanked Council Member Elliott for his service to the City.
