ORDINANCE NO, 1447 (#09 - 12)
AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE,ARKANSAS, FOR THE PURPOSE OF COMPLETION OF THE
EXTENSION AND UPGRADE OF THE JACKSONVILLE WASTEWATER
UTILITY'S COLLECTION SYSTEM FOR THE VALENTINE-WOOTEN ROAD
PROJECT;AND, FOR OTHER PURPOSES.
WHEREAS, once completed, the Valentine-Wooten Road Sewer Project will
extend sanitary sewer service from the Jacksonville Wastewater Utility for an area
that has sought and been unable to obtain such service for many years, and doing
so will FINALLY provide sanitary sewer service to approximately Two Hundred (200)
households that are currently limited to septic and other discharge methods, some
of which create environmental issues;
WHEREAS, the Jacksonville Wastewater Utility has been involved in these
efforts to extend sanitary sewer services to the Valentine-Wooten Road area for
approximately Nineteen (19) years and believes extension of the Utility's system is
best for the citizens of the area and for current and future needs of the Utility; and,
WHEREAS, to do so, it is necessary to obtain additional equipment and
services for the existing Valentine Wooten Road Project to encompass work required
to complete the Project through the existing contractor, Arkansas Cleaning &
Televising, who successfully secured said Project through the competitive bidding
process earlier this year. However, with funding sources changing for this final
portion of the Project, grant funds will now be administered through the City of
Jacksonville, and increased costs and delay will result should another contractor
become involved. Thus, it is clear that additional competitive bidding would not be
feasible for this Project.
BE IT ORDAINED A N D ENACTED BY THE CITY COUNCIL OF THE CITY
OF JACKSONVILLE,ARKANSAS:
SECTION ONE: Competitive bidding for the purpose of approval for
additional work required to insure completion of the extension of sanitary sewer
services for the Valentine-Wooten Road Sewer Project would be costly, non-
productive and time consuming, making said competitive bidding unfeasible and
impractical.
SECTION TWO: Pursuant to ACA § 14-58-303, competitive bidding is
hereby waived for the purpose of approval for repair(s) of existing and construction
of new manholes, repairs in existing pipe, changes in grade in Nine (9) locations,
road cut(s) and repair(s), pump station control- panel repairs, and various other
repairs/replacements necessary for the extension of, upgrade and completion of the
existing Valentine-Wooten Road Sewer Project as additional improvements to the
Collection System for the Jacksonville Wastewater Utility. Authorization is hereby
given to the Mayor and/or his designated representative to execute necessary
documents with Arkansas Cleaning &Televising, of Little Rock, Arkansas, the only
contractor currently working on the Project. It is anticipated that the equipment and
services, as specified and currently known, will be provided for a total cost to the

City of Jacksonville by and through the Jacksonville Wastewater Utility, not to
exceed Ninety-five Thousand Seven Hundred Ninety-five Dollars ($95,795.00).
SECTION THREE: Said approval is contingent upon receipt of grant
funding from the Delta Regional Authority (State Funds) for all final costs of said
Project. No general City revenues shall be or are approved for said Project. As well,
ALL funding and approval is contingent upon the residents of the Valentine Wooten
Road area encompassed by this Project approving a voluntary annexation into the
City of Jacksonville.
SECTION FOUR: All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.
SECTION FIVE: This Ordinance shall take effect upon passage and
publication, as provided by and subject to the requirements of applicable law.
