1615ORDINANCE NO. 1615 (#22-2019)
AN ORDINANCE APPROVING THE DETACHMENT OF LANDS FROM THE
CITY OF JACKSONVILLE TO BE ANNEXED INTO THE CITY OF
SHERWOOD, AND FOR OTHER PURPOSES.
WHEREAS, The City of Sherwood, Arkansas, pursuant to Ark. Code Sec.
14-40-2101, adopted Sherwood City Ordinance 2261 on July 22nd, 2019. The
Ordinance called for the detachment of two (2) properties from the City of
Jacksonville to be annexed into the City of Sherwood, and
WHEREAS, the required public hearing was conducted by the City of
Jacksonville on September 19th, 2019 at 6:11 p.m. regarding the proposed
detachment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
JACKSONVILLE, ARKANSAS;
SECTION ONE; Sherwood City Ordinance 2261, attached hereto as
Exhibit 1 and incorporated herein by reference provides the descriptions of the
two (2) parcels of property the City of Sherwood requests be detached from the
City of Jacksonville to be annexed into the City of Sherwood.
SECTION TWO; The City of Jacksonville hereby approves the
detachment of the two (2) parcels from the City of Jacksonville to be annexed
into the City of Sherwood.

CURRENTLY LOCATED IN JACKSONVILLE,
PULASKI COUNTY ARKANSAS, PURSUANT TO
ARK. CODE ANN. §14-40-2101.
WHEREAS, Ark, Code Ann. §14-40-2101 provides a procedure by which
property may be simultaneously detached from one municipality and annexed into an
adjoining municipality; and
WHEREAS, the City of Sherwood, Arkansas, desires to detach and annex the
following described properties ("the Properties") currently located in the City of
Jacksonville, Pulaski County, Arkansas:
Property 1. All unplatted part of SfE22-3N-1 1 W including all adjoining public
rights of way.
Property 2. PT NW NW Lying N&W of LIWy 107 EXC 0,47 AC FOR RAW Hwy
107 22 -3N -I I W
WHEREAS, a map showing the location of the Properties is attached hereto as
Exhibit "A"; and
WHEREAS, the City of Sherwood and Jacksonville have reached an agreement
relative to the detachment and annexation of the Properties, and the City of Sherwood
stands ready to provide all municipal services to the Properties; and
WHEREAS, the City of Sherwood. Arkansas, wishes to comply with the
provisions of Ark, Code Ann. §14-40-2101;
NOW, THEREFORE, 13E IT ORDAINED BY THE CITY COUNCIL FOR
THE CI'T'Y OF SHERWOOD, ARKANSAS:
Section l: That the Properties described herein and in the attached Exhibit "A" be
simultaneously de -annexed from the City of Jacksonville, Arkansas, and annexed into the
City of Sherwood, Arkansas, pursuant to Ark. Code Ann, §14-40-2101;
Section 2: That the City Clerk is hereby directed to send a copy of this ordinance
to the governing body of the City of Jacksonville, Arkansas, pursuant to Ark. Code Ann.
§ 14.40-2101(a);
Section 3: Pursuant to Ark. Code Ann. §14-40-2101(b)(2), the City of
Jacksonville, Arkansas, shall conduct a public hearing within sixty (60) days of the date of
passage of this ordinance:
Section 4: Pursuant to Ark. Code Ann. §14-40-2101(b)(3), the City Clerk ofthe
City of Sherwood, Arkansas, is directed to publish a legal notice of the public hearing at
least fifteen (15) days prior to the public. (tearing, and such notice shall set out the legal
description of the properties proposed to be detached and annexed;
Section 5: if the City Council for the City of Jacksonville, Arkansas, approves the
proposed detachment and annexation ordinance, the City of Sherwood shall proceed to
render services to the newly annexed area, pursuant to Ark. Code Ann, §14-40-2101(c)(2);
Section 6: If the City Council for the City of.lacksonville Arkansas, approves the
proposed detachment and annexation ordinance, and if no suit is brought within thirty (30)
days to review the rttutual actions of the City of Sherwood and the City of Jacksonville,
then the detachment and annexation of the land shall be final, pursuant to Ark. Code Ann.
j 14-40-2l01(d), and the Cite Clerk of the t.lty of Slie rvwod, ,ArkaiIsati. shall at that time
cerlify a copy of the plat of the amwxed properties and a copy of the 01JuuuiCCs passed to
the County Clerk of Pulaski County, Arkansas, pursuant to Ark Code Azul. §14-40-
2101(c)(2), who shall forward a Copy u( C21C11 ClOCUrnCnt to the SCUCIL11) of State for the
State of Arkansas, who shall file and preserve diem.
