0678 RESOLUTION NO. 678 (#04 - 12)
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK OF THE
CITY OF JACKSONVILLE, ARKANSAS, TO EXECUTE ALL
APPROPRIATE DOCUMENTS FOR THE TRANSFER OF CERTAIN REAL
PROPERTY; AND, FOR OTHER PURPOSES.
WHEREAS, in the re-development of the Sunnyside Addition of the
City of Jacksonville, the City has worked jointly with officials and
members of the Victory Praise 86 Worship Church, located at 424 Church
Street, to remove all Code violations upon the property located at 125
Roosevelt Circle, Jacksonville. Said property was transferred to the City
in lieu of condemnation because of existing Code violations for the
structure formerly present on the property;
WHEREAS, through the generosity of Victory's church body, part
of the labor and equipment for the demolition and clearing required of
the dilapidated structure at 125 Roosevelt Circle was partially completed
by church members and volunteers. As a result and for the benefit of
the area, the City believes it is in the best interests of the Sunnyside
Addition to transfer said real property to the church for further
development of their Worship Center and facilities; and,
WHEREAS, in accordance with State law, the Jacksonville City
Council must approve the transfer of said real property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor and City Clerk are hereby
authorized to execute the necessary documentation on behalf of the City
of Jacksonville, Arkansas, for transfer of the real property described
below owned by the City of Jacksonville to the Victory Praise 86 Worship
Church. The property to be transferred is more fully described as
follows:
Part of Lot 212, Block 0, Sunnyside Hills Addition to the City
of Jacksonville, Pulaski County, Arkansas, being more
particularly described as follows: Beginning at the
Northwesterly corner of said Lot 212; thence Southeast along
Roosevelt Circle 28.22 feet; thence South 6 degrees 10
minutes East 30.53 feet; thence South 26 degrees 22

minutes West 57.64 feet to the South line of Lot 212; thence
West along the South line of said Lot 212 63.84 feet to the
Southwest corner of said Lot 212; thence Northwesterly 11
feet to the Southwest corner of Lot 211, Sunnyside Hills
Addition; thence Northeast 118 feet to the Point of
Beginning.

SECTION TWO: The documentation executed to transfer
said properties will provide appropriate limitations regarding potential
future uses and provisions for relevant issues regarding the property
transfer in order to satisfy all local, state, and federal directives,
guidelines, and requirements.
SECTION THREE: Any and all other Resolutions in
conflict herewith are hereby repealed to the extent of said conflict. This
Resolution shall be in effect from and after its date of passage.
